GENERAL ASSEMBLY STRESSES IMPORTANCE OF WORLD COURT NUCLEAR WEAPON OPINION, AS IT ADOPTS 48 DISARMAMENT-RELATED TEXTS
19961210 Resolutions Also Address Nuclear-Weapon-Free Zones, Bilateral Disarmament Negotiations, Elimination of Nuclear WeaponsThe General Assembly this afternoon expressed its conviction that the continuing existence of nuclear weapons poses a threat to all humanity, and that their use would have catastrophic consequences for life on the planet.
In adopting a resolution on the advisory opinion of the International Court of Justice on the legality of the threat or use of nuclear weapons, the Assembly underlined the unanimous opinion of the Court that there exists an obligation to pursue in good faith negotiations leading to nuclear disarmament, and it called on all States to fulfil that obligation immediately. The resolution was adopted by a vote of 115 in favour to 22 against, with 32 abstentions. (For details of the vote, see Annex XXIII.)
The Assembly took that action in the course of adopting 45 resolutions and 2 decisions on disarmament matters submitted by its First Committee (Disarmament and International Security). It also adopted a resolution on Antarctica.
Prior to acting on the resolution on the Court's opinion, the Assembly took separate votes on operative paragraphs 3 and 4.
Operative paragraph 3, citing the existence of an obligation to pursue good-faith negotiations aimed at nuclear disarmament, was adopted by a vote of 139 in favour to 7 against (France, Latvia, Monaco, Romania, Turkey, United Kingdom, United States), with 20 abstentions. (See Annex XXI.)
Operative paragraph 4, calling on States to "fulfil that obligation immediately", was adopted by a vote of 110 in favour to 27 against, with 29 abstentions (Annex XXII).
By one text on nuclear disarmament, submitted by the countries of the Non-Aligned Movement and adopted by a vote of 110 in favour to 39 against, with 20 abstentions, the Assembly urged the nuclear-weapon States to stop

qualitative improvement and stockpiling of nuclear warheads and delivery systems. It called on them to undertake phased reductions of nuclear weapons with a view to their total elimination within a time-bound framework (Annex XXIV).
Under the terms of a related resolution on disarmament aimed at the ultimate elimination of nuclear weapons, the Assembly called on the nuclear- weapon States to reduce nuclear weapons with the ultimate goal of eliminating them. It urged States not party to the Treaty on the Non-Proliferation of Nuclear Weapons (NPT) to accede to it. It adopted that text by a vote of 159 in favour to none against, with 11 abstentions (Annex XV).
Prior to voting on the resolution as a whole, the Assembly took action on preambular paragraph 7 and operative paragraph 1.
It adopted preambular paragraph 7, which welcomes this year's adoption of the Comprehensive Nuclear-Test-Ban Treaty, by a vote of 161 in favour to 1 against (India), with 5 abstentions (Cuba, Lebanon, Libya, Syria, United Republic of Tanzania) (Annex XIII).
It adopted operative paragraph 1, whereby the Assembly would urge States not party to the NPT to accede to it, by a vote of 161 in favour to 3 against (India, Israel, Nepal), with 2 abstentions (Brazil, Cuba) (Annex XIV).
By a third resolution on nuclear disarmament, the Assembly again requested the Conference on Disarmament to begin negotiations for an international convention to prohibit the use of nuclear weapons. In adopting that text by a vote of 114 in favour to 31 against, with 27 abstentions, it proposed a draft text annexed to the resolution as a possible basis for that agreement (Annex XXX).
The Assembly adopted two texts on bilateral nuclear-arms negotiations, although the resolutions differed on the pace of nuclear disarmament and the recognition of existing agreements. By one text, it encouraged the Russian Federation, the United States, Belarus, Kazakstan and Ukraine to continue cooperative efforts aimed at eliminating nuclear weapons and strategic offensive arms. It adopted that resolution by a vote of 160 in favour to none against, with 11 abstentions (Annex XXVII).
In adopting a second text on bilateral nuclear-arms negotiations, sponsored by the countries of the Non-Aligned Movement, the Assembly called upon the Russian Federation and the United States to intensify efforts to achieve deep nuclear-weapon reductions in order to contribute to the elimination of nuclear weapons within a time-bound framework. It took that action by a vote of 107 in favour to 37 against, with 24 abstentions (Annex XIX).

In the first of five resolutions on nuclear-weapon-free zones, the Assembly called upon States parties and signatories to the treaties establishing nuclear-weapon-free zones in Latin America and the Caribbean, in the South Pacific, South-East Asia and Africa, to implement further cooperation, including efforts to consolidate the status of the nuclear- weapon-free Southern hemisphere and adjacent areas. It adopted that text by 129 in favour to 3 against (France, United Kingdom, United States), with 38 abstentions (Annex X).
It reaffirmed its endorsement of the concept of a nuclear-weapon-free zone in South Asia, and welcomed the support of all five nuclear-weapon States for the proposal. That resolution was adopted by a vote of 156 in favour to 3 against (Bhutan, India, Mauritius), with 8 abstentions (Afghanistan, Algeria, Cuba, Cyprus, Indonesia, Lao People's Democratic Republic, Myanmar, Viet Nam) (Annex III).
Acting without a vote on the issue of nuclear-weapon-free zones, the Assembly:
-- Urged all concerned parties to consider taking the steps needed to establish a nuclear-weapon-free zone in the Middle East;
-- Called upon African States to sign and ratify the African Nuclear- Weapon-Free Zone Treaty (Pelindaba Treaty);
-- Welcomed recent steps for consolidation of the regime of military denuclearization established by the Treaty for the Prohibition of Nuclear Weapons in Latin America and the Caribbean (Treaty of Tlatelolco).
By the terms of a resolution on the risk of nuclear proliferation in the Middle East, adopted by a vote of 129 in favour, to 3 against (Israel, Federated States of Micronesia, United States), with 32 abstentions, the Assembly called upon Israel to accede without further delay to the Treaty on the Non-Proliferation of Nuclear Weapons (NPT) and to place its nuclear facilities under International Atomic Energy Agency (IAEA) safeguards (Annex XXXIII).
Prior to voting on the resolution as a whole, the Assembly adopted preambular paragraph 6 by a vote of 155 in favour to 2 against (India, Israel), with 8 abstentions (Cuba, Equatorial Guinea, Federated States of Micronesia, Fiji, Guatemala, Marshall Islands, Nicaragua, Pakistan). That paragraph recalls that the Conference on Disarmament urged universal adherence to the NPT as an urgent priority (Annex XXXII).
Acting without a vote, the Assembly called on States to sign and/or ratify the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction without

delay. It stressed the importance of the United States and the Russian Federation being among the original States parties to the Convention.
Also without a vote, it called on States that have not signed the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) Weapons and on Their Destruction, to become parties at an early date.
The Assembly also urged States to pursue an effective international agreement to ban the use, production and transfer of anti-personnel land- mines. It urged them to accede to the Convention on Certain Conventional Weapons and to its amended Protocol II. It adopted that resolution by a vote of 155 in favour to none against, with 10 abstentions (Belarus, China, Cuba, Democratic People's Republic of Korea, Israel, Pakistan, Republic of Korea, Russian Federation, Syria, Turkey) (Annex XXVIII).
By a vote of 125 in favour to none against, with 45 abstentions, the Assembly reaffirmed the need to reach early agreement on security arrangements for non-nuclear-weapon States. It appealed to all States, especially the nuclear-weapon States, to work towards a common approach and formula for a binding international instrument (Annex IV).
Acting without a vote this afternoon, the Assembly:
-- Called upon States to prevent dumping of radioactive wastes, and requested the Conference on Disarmament to take radioactive wastes into account in negotiations for a convention on the prohibition of nuclear weapons;
-- Reaffirmed the need for measures to prevent the emergence of new types of weapons of mass destruction;
-- Called upon States to become parties to the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons Which May Be Deemed to Be Excessively Injurious or to Have Indiscriminate Effects (Convention on Certain Conventional Weapons);
-- Urged the international community to devote resources made available by implementation of disarmament agreements to economic and social development;
-- Welcomed adoption by the Disarmament Commission of its guidelines for international arms transfers and invited Member States to enact legislation to control export and import of arms;

-- Recommended the guidelines for objective information on military matters to all Member States for implementation, and requested them to report annually their military expenditures;
-- Encouraged the Secretary-General to continue his efforts to curb the circulation of small arms, and encouraged national commissions against the proliferation of small arms in the Saharo-Sahelian subregion;
-- Stressed the importance of practical disarmament measures in areas affected by conflict, including collection and disposal of small arms and light weapons, reintegration of former combatants, and demining;
-- Recommended that the United Nations Disarmament Information Programme focus on informing, educating and generating public understanding for multilateral disarmament action;
-- Reaffirmed its support for the United Nations Regional Centre for Peace and Disarmament in Asia and the Pacific;
-- Reaffirmed its support for the Centre for Peace and Disarmament in Africa;
-- Welcomed the Non-Aggression Pact between States members of the Standing Advisory Committee on Security Questions in Central Africa;
-- Requested the Secretary-General to continue to implement the Geneva- based United Nations disarmament fellowship, training and advisory services programme;
-- Recommended that the Commission on Disarmament consider three priority items at its 1997 substantive session;
-- Reaffirmed the role of the Conference on Disarmament as the international community's single multilateral disarmament negotiating forum, and welcomed its decision to expand its membership with 23 new members;
-- Called on the States of the Middle East region to adhere to the principles of non-interference, non-intervention, and non-use of force and the inadmissibility of the acquisition of territory by force; and
-- Recognized that the 1959 Antarctic Treaty is in furtherance of the principles of the United Nations Charter.
Also, the Assembly renewed its call to all States to observe the principles and objectives of the 1925 Geneva Protocol for the Prohibition of the Use in War of Asphyxiating, Poisonous or Other Gases, and of Bacteriological Methods of Warfare. It called on States maintaining

reservations to the Protocol to withdraw them. It took that action by a vote of 165 in favour to none against, with 7 abstentions (Belarus, Israel, Kazakstan, Republic of Korea, Russian Federation, Tajikistan, United States) (Annex XXV).
By the terms of a resolution on the role of science and technology in the context of disarmament, adopted by a vote of 105 in favour to 39 against, with 24 abstentions, the Assembly urged Member States to negotiate acceptable guidelines for international transfers of dual-use technologies and high technology with military applications. It would take into account legitimate defence requirements (Annex I).
By a second draft on the role of science and technology in the context of disarmament and other related fields, adopted by a vote of 161 in favour to none against, with 8 abstentions (Democratic People's Republic of Korea, Federated States of Micronesia, India, Iran, Japan, Pakistan, Sri Lanka, United States), the Assembly invited Member States to develop international rules on transfers of high technology with military applications (Annex II).
The Assembly called on all States, particularly those with major space capabilities, to contribute actively to the prevention of an outer space arms race, according to a resolution adopted by a vote of 126 in favour to none against, with 44 abstentions. It urged States conducting activities in outer space to keep the Conference on Disarmament informed of progress in relevant bilateral and multilateral negotiations (Annex VII).
Before taking action on the draft as a whole, the Assembly voted separately on preambular paragraph 17 and operative paragraph 6. Preambular paragraph 17, which recognizes that the fundamental task of the ad hoc committee of the Conference on Disarmament remains the conclusion of an agreement to prevent an arms race in outer space, was adopted by a vote of 116 in favour to 1 against (United States), with 45 abstentions (Annex V). It adopted operative paragraph 6, requesting the Conference to re-establish the ad hoc committee, by a vote of 117 in favour to 1 against (United States), with 45 abstentions (Annex VI).
By the terms of a related resolution, adopted by a vote of 137 in favour to 4 against (France, Israel, United Kingdom, United States), with 27 abstentions, it invited the Conference on Disarmament to include environmental norms and provisions in negotiating arms control and disarmament agreements. It called on States to ensure that the application of science and technology to disarmament was without detriment to the environment (Annex XII).
Under a resolution on the fourth special session of the General Assembly devoted to disarmament, the Assembly decided, subject to the emergence of a consensus on its objectives and agenda, to convene that session in 1999. It adopted that text by a recorded vote of 163 in favour to 2 against (Israel,

United States), with 5 abstentions (Denmark, Latvia, Russian Federation, Tajikistan, Uzbekistan) (Annex XI).
By terms of another text, adopted by a vote of 154 in favour to none against, with 15 abstentions, the Assembly called on Member States to provide data for the United Nations Register of Conventional Arms. It requested their views on further development of the Register and on measures relating to weapons of mass destruction (Annex XVIII).
Prior to voting on the resolution as a whole, the Assembly adopted operative paragraph 3 (b), which requests the Secretary-General to prepare a report on the Register's continuing operation, by a vote of 147 in favour to none against, with 13 abstentions (Annex XVI).
It adopted operative paragraph 5, inviting the Conference on Disarmament to continue work in the field of transparency in armaments, by a vote of 146 in favour to none against, with 18 abstentions (Annex XVII).
According to a resolution on regional disarmament, adopted by a vote of 170 in favour to none against, with 1 abstention (India), the Assembly called on States to conclude agreements for disarmament and confidence-building measures at the regional and subregional levels. It affirmed that global and regional approaches to disarmament complemented each other and should be pursued simultaneously (Annex XX).
By a resolution on conventional arms control at the regional and subregional levels, the Assembly requested the Conference on Disarmament to consider a framework for regional agreements on conventional arms control. It adopted that text by a vote of 164 in favour to 1 against (India), with 2 abstentions (Cuba, Libya) (Annex XXVI).
By one of three resolutions on the review of the implementation of the recommendations and decisions adopted by the General Assembly at its tenth special session, it recognized the legitimate aspirations of all countries to participate fully in the work of the Conference on Disarmament. The Assembly adopted that text by a vote of 171 in favour to none against, with 2 abstentions (Turkey, United States) (Annex XXXI).
The Assembly again stated its conviction that participation by all the permanent members of the Security Council and the major maritime users of the Indian Ocean in the work of the Ad Hoc Committee on that ocean would help advance peace, security and stability in the region. It adopted that resolution by a vote of 131 favour to 3 against (France, United Kingdom, United States), with 37 abstentions (Annex XXXIV).

The Assembly called on States and international organizations to continue actions aimed at preventing the violent disintegration of States by a vote of 162 in favour to none against, with 8 abstentions (Algeria, Armenia, China, Costa Rica, Guatemala, Mexico, Pakistan, Tanzania) (Annex XXXV).
The Assembly also adopted two decisions. According to the first, adopted by a vote of 118 in favour to none against, with 53 abstentions, it decided to include the item entitled "Review of the Implementation of the Declaration on the Strengthening of International Security" in its 1997 provisional agenda (Annex XXXVI).
According to a second decision, on the non-proliferation of weapons of mass destruction and their delivery vehicles, adopted by a vote of 121 in favour to none against, with 52 abstentions, the Assembly decided to include the item on the provisional agenda of its 1997 session (Annex XXIX).
The Assembly will meet again at 3 p.m. Wednesday, 11 December, to consider operational activities for development: commemoration of the fiftieth anniversary of the operations of the United Nations Children's Fund.
Assembly Work Programme
The General Assembly met this afternoon to take action on 22 reports of the First Committee (Disarmament and International Security). The reports contain 47 draft resolutions and decisions on disarmament issues, as well as one draft text on Antarctica.
The report of the First Committee on prohibiting the development and manufacture of new types of weapons of mass destruction (document A/51/566/Add.1), contains one draft resolution whereby the Assembly would reaffirm that effective measures should be taken to prevent the emergence of new types of weapons of mass destruction. It would ask the Conference on Disarmament to keep the matter under review in order to make recommendations for specific negotiations on identified types of such weapons.
The draft was approved by the Committee on 11 November without a vote.
By the terms of a draft resolution contained in the report on transparency of military expenditures (document A/51/566/Add.2), the Assembly would recommend the guidelines for objective information on military matters to all Member States for implementation, and request them to report annually to the Secretary-General their military expenditures for the latest fiscal year. It would call on them to provide their views on strengthening and broadening participation in the reporting system of military expenditures.
The Committee approved that draft without a vote on 14 November.
According to a draft resolution contained in the report on the role of science and technology in the context of international security and disarmament (document A/51/566/Add.3), the Assembly would urge Member States to undertake negotiations to establish acceptable guidelines for international transfers of dual-use goods and technologies and high technology with military applications. It would invite them to apply science and technology for disarmament-related purposes, and to make those technologies available to interested States.
The Committee approved that text on 14 November by a vote of 81 in favour to 39 against, with 22 abstentions.
By a draft resolution on the role of science and technology in the context of international security, disarmament and other related fields (document A/51/566/Add.4), the Assembly would invite Member States to enhance dialogue with a view to ensuring implementation of international legal commitments and developing international legal rules on transfers of high technology having military applications.

The draft was approved by the Committee on 14 November by a recorded vote of 137 in favour to none against, with 11 abstentions.
The report on amending the treaty banning nuclear weapon tests in the atmosphere, in outer space and under water (document A/51/566/Add.5) indicates that no action was taken by the First Committee on that item.
The report on implementation of the Comprehensive Nuclear-Test-Ban Treaty (CTBT) (document A/51/566/Add.6) also indicates that no action was taken by the Committee on that item.
By a draft resolution in the report on the establishment of a nuclear- weapon-free zone in the Middle East (document A/51/566/Add.7), the Assembly would urge all concerned parties to consider steps to establish such a zone, and to adhere to the Treaty on the Non-Proliferation of Nuclear Weapons (NPT). Pending establishment of the zone, the Assembly would call on all countries of the region to place all their nuclear activities under International Atomic Energy Agency (IAEA) safeguards. It would invite them not to develop or acquire nuclear weapons or permit their stationing on their territories or territories under their control. It would stress the need for rapid progress in the bilateral Middle East peace negotiations.
The draft as amended was approved in Committee on 18 November without a vote.
By a draft resolution contained in the report on establishment of a nuclear-weapon-free zone in South Asia (document A/51/566/Add.8), the Assembly would reaffirm its endorsement of the concept of such a zone, and urge the States of South Asia to continue efforts to establish the zone and refrain from any action contrary to that objective. It would call upon all five nuclear-weapon States to cooperate in efforts to establish the zone.
The Committee approved the draft resolution on 11 November by a recorded vote of 130 in favour to 3 against (Bhutan, India, Mauritius), with 8 abstentions (Afghanistan, Algeria, China, Cyprus, Indonesia, Lao People's Democratic Republic, Myanmar, Viet Nam).
According to a draft contained in the report on security assurances for non-nuclear-weapon States (document A/51/566/Add.9) the Assembly would reaffirm the need to reach early agreement on such security arrangements -- appealing to all States, especially the nuclear-weapon States, to work towards early agreement on a common formula for a legally binding international instrument. It would recommend that the Conference on Disarmament continue negotiations for effective international arrangements for security assurances.
The draft resolution was approved by the Committee on November 11 by a recorded vote of 100 in favour to none against, with 43 abstentions.

By a draft resolution in the report on preventing an outer space arms race (document A/51/566/Add.10), the Assembly would reaffirm its recognition that the legal regime applicable to outer space did not by itself guarantee the prevention of such an arms race, and must be reinforced. It would call on all States, particularly those with major space capabilities, to contribute to the prevention of an outer space arms race. It would ask the Conference on Disarmament to re-establish the relevant ad hoc committee with a view to negotiating multilateral agreements on preventing such an arms race. It would urge States conducting activities in outer space and those interested in doing so to keep the Conference informed of progress in their relevant bilateral and multilateral negotiations.
The Committee approved that draft text on 14 November by a vote of 98 in favour to none against, with 40 abstentions.
The report on general and complete disarmament (document A/51/566/Add.11) contains 20 draft resolutions and one draft decision.
By draft resolution A, on the Review Conference of the Parties to the Non-Proliferation Treaty, the Assembly would take note of the decision of the parties to the NPT to hold the first meeting of the Preparatory Committee in New York from 7 to 18 April 1997, for the Review Conference to be held in the year 2000.
The Committee approved that draft on 15 November by a vote of 142 in favour to none against, with 2 abstentions (India, Israel).
By the terms of draft resolution B, on the nuclear-weapon-free Southern hemisphere and adjacent areas, the Assembly would urge ratification of the Treaties of Tlatelolco, Rarotonga, Bangkok and Pelindaba by all regional States, and adherence to their protocols by all relevant States. It would call upon all States to consider proposals for further nuclear-weapon-free zones, especially in areas such as South Asia and the Middle East. It would call upon States parties and signatories to the above treaties to implement further means of cooperation, including efforts to consolidate the status of the nuclear-weapon-free southern hemisphere and adjacent areas.
[The treaties cited above are: the Treaty for the Prohibition of Nuclear Weapons in Latin America and the Caribbean (Treaty of Tlatelolco); the South Pacific Nuclear-Free Zone Treaty (Treaty of Rarotonga); the South-East Asia Nuclear-Weapon-Free Zone Treaty (Bangkok Treaty); and the African Nuclear-Weapon-Free Zone Treaty (Pelindaba Treaty).]
The First Committee approved that draft on 13 November by a recorded vote of 111 in favour to 4 against (Canada, France, United Kingdom, United States), with 36 abstentions.

By the terms of draft resolution C, on the fourth special session of the General Assembly devoted to disarmament, the Assembly would decide, subject to the emergence of a consensus on its objectives and agenda, to convene that session in 1999. It would decide to convene a meeting of the Preparatory Committee for the special session before the end of the Assembly's current session.
The Committee approved the draft on 18 November by a recorded vote of 137 in favour to 2 against (Israel, United States), with 1 abstention (Russian Federation).
By draft D, on the relationship between disarmament and development, the Assembly would urge the international community to devote resources made available by implementation of disarmament agreements to economic and social development. It would invite all Member States to communicate their proposals for implementation of the action programme of the International Conference on the Relationship between Disarmament and Development.
The Committee approved that draft without a vote on 14 November.
By draft resolution E, on environmental norms in disarmament and arms control agreements, the Assembly would invite the Conference on Disarmament to take every necessary measure to include environmental norms and provisions in negotiating arms control and disarmament agreements. It would ask the Conference to take radioactive wastes into account in negotiating for a convention on the prohibition of radiological weapons. It would urge States parties to comply with the provisions of the Treaty on the Prohibition of the Emplacement of Nuclear Weapons and Other Weapons of Mass Destruction on the Seabed and the Ocean Floor and in the Subsoil Thereof. It would call on States possessing nuclear weapons and other weapons of mass destruction to become parties to that Treaty. It would call upon States to adopt measures to ensure that the application of scientific and technological progress to disarmament was without detriment to the environment and contributed to the attainment of sustainable development.
The Committee approved that text on 14 November by a vote of 116 in favour to 4 against (France, Israel, United Kingdom, United States), with 26 abstentions.
By draft text F, on curbing the illicit transfer and use of conventional arms, the Assembly would welcome adoption by the Disarmament Commission of its guidelines for international arms transfers. It would invite Member States to enact national legislation to exercise control over the export and import of arms, and invite them to report to the Secretary-General by 15 April 1997 on those measures and on proposals for measures to curb the illicit transfer and use of conventional arms.

According to draft resolution G, on nuclear disarmament with a view to the elimination of nuclear weapons, the Assembly would call for the pursuit by the nuclear-weapon States of efforts to reduce nuclear weapons globally, with the ultimate goal of eliminating them. It would urge those States not party to the NPT to accede to it at the earliest possible date. It would also call on all States parties to work for a smooth start of the strengthened review process at the Preparatory Committee convened in 1997 for the next Review Conference, to be held in the year 2000.

By draft text H, on transparency in armaments, the Assembly would call on Member States to provide data for the United Nations Register of Conventional Arms. It would request Member States to provide the Secretary- General with their views on the further development of the Register and on transparency measures relating to weapons of mass destruction. It would request the Secretary-General to ensure that sufficient resources were made available for operation of the Register, and would invite the Conference on Disarmament to consider continuing its work on transparency in armaments.
The Committee approved that draft on 14 November by a vote of 133 in favour to none against, with 15 abstentions.
According to draft I, on bilateral nuclear-arms negotiations and nuclear disarmament, the Assembly would call upon the Russian Federation and the United States to intensify efforts to achieve deep reductions in their nuclear armaments, in order to contribute to the elimination of nuclear weapons within a time-bound framework. It would urge those States to make further efforts to bring the Treaty on Further Reduction and Limitation of Strategic Offensive Arms (START II) into force, and invite them to keep the Conference on Disarmament informed of their progress.
The draft was approved on 12 November by a recorded vote of 83 in favour to 36 against, with 21 abstentions.
According to draft resolution J, on prohibiting the dumping of radioactive wastes, the Assembly would call upon all States to take measures aimed at preventing any dumping of nuclear or radioactive wastes that would infringe upon the sovereignty of States. It would ask the Conference on Disarmament, in negotiating a convention on the prohibition of nuclear weapons, to take radioactive wastes into account, and further request the Conference to intensify its efforts towards early conclusion of such a convention.

According to draft text K, on regional disarmament, the Assembly would call on States to conclude agreements for nuclear non-proliferation, disarmament and confidence-building measures at the regional and subregional levels. It would stress the need for sustained efforts, within the framework of the Conference on Disarmament and under the umbrella of the United Nations, to make progress on the entire range of disarmament issues. It would also affirm that global and regional approaches to disarmament complemented each other and should, therefore, be pursued simultaneously.
The draft was approved by the Committee on 14 November by a recorded vote of 145 in favour to none against, with 1 abstention (India).
Draft L, on curbing the illicit traffic in small arms, would have the Assembly encourage the Secretary-General to continue his efforts to curb the circulation of such arms and collect them, with the support of the United Nations Regional Centre for Peace and Disarmament in Africa and in close cooperation with the Organization of African Unity (OAU). The Assembly would encourage the setting up of national commissions against the proliferation of small arms in the countries of the Saharo-Sahelian subregion.

Draft resolution M, on the advisory opinion of the International Court of Justice on nuclear weapons, would have the Assembly underline the Court's unanimous conclusion that an obligation exists to pursue good-faith negotiations leading to nuclear disarmament. It would call on all States to fulfil that obligation immediately by starting multilateral negotiations in 1997 leading to early conclusion of a convention to prohibit the development, production, testing, deployment, stockpiling, transfer, threat or use of nuclear weapons, and providing for their elimination.
The draft was approved by the Committee on 14 November by a recorded vote of 94 in favour to 22 against, with 29 abstentions.
By the terms of draft resolution N, on practical disarmament measures, the Assembly would stress the importance of certain practical disarmament measures for consolidating peace and security in areas that had suffered from conflict. Those measures would include the collection, control and disposal of arms, especially small arms and light weapons, coupled with restraint over the production and procurement as well as transfers of such arms, the demobilization and reintegration of former combatants, demining, and conversion. The Assembly would ask the Secretary-General to develop guidelines for an integrated approach to such measures, and call upon Member States and regional bodies to contribute actively to their implementation.

The Conference on Disarmament would be called on to begin negotiations early in 1997 on a programme of nuclear disarmament aimed at the eventual elimination of nuclear weapons.

According to draft resolution P, on measures to uphold the authority of the 1925 Geneva Protocol, the Assembly would renew its call to all States to observe the principles and objectives of the 1925 Geneva Protocol for the Prohibition of the Use in War of Asphyxiating, Poisonous or Other Gases, and of Bacteriological Methods of Warfare. It would call on those States that continued to maintain reservations to the Protocol to withdraw them.

It would urge States that had not yet done so to accede to the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons Which May Be Deemed to Be Excessively Injurious or to Have Indiscriminate Effects (Convention on Certain Conventional Weapons), and to its amended Protocol II. It would urge all States to comply with that Protocol, and would call upon States that had not yet done so to declare and implement bans, moratoriums or other restrictions on anti- personnel land-mines, particularly on their operational use and transfer.

According to draft resolution T, on the status of the Chemical Weapons Convention, the Assembly would welcome the entry into force in April 1997 of the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction. It would stress the importance to the Convention that possessors of chemical weapons or chemical weapons production facilities should be among the original parties to the Convention -- and in that context, the importance of the United States and Russian Federation being among the original States parties to the Convention.

Under draft B, on the United Nations Regional Centre for Peace and Disarmament in Asia and the Pacific, the Assembly would reaffirm its support for the operation and strengthening of the Centre as an essential promoter of the regional peace and disarmament dialogue known as the "Kathmandu process". It would appeal to Member States and international governmental and non- governmental organizations and foundations to make voluntary contributions to the Centre.

By draft E on the United Nations Regional Centre for Peace and Disarmament in Africa, the Assembly would reaffirm its support for the further operation and strengthening of the Centre. By draft resolution A of that report, on expanding the membership of the Conference on Disarmament, the Assembly would recognize the legitimate aspirations of all countries to participate fully in the work of the Conference. It would call upon that body to consider all remaining applications for membership, with a view to deciding on its further enlargement before the end of its 1997 session.

By draft B on the report of the Disarmament Commission, the Assembly would endorse the guidelines for international arms transfers adopted by the Commission in 1996. It would reaffirm the Commission's role as the specialized body within the United Nations disarmament machinery for deliberation on disarmament issues. The Assembly would encourage the Commission to give focused consideration to a limited number of priority issues, bearing in mind its decision to move its agenda towards a three-item phased approach. It would recommend that the Commission adopt three items for consideration at its 1997 substantive session.

The report on the Convention on Certain Conventional Weapons contains a draft resolution which would have the Assembly call upon all States to become parties to the Convention and its protocols as soon as possible. The report on strengthening security and cooperation in the Mediterranean region (document A/51/566/Add.16) contains a draft resolution by which the Assembly would call for full adherence to the principles of non- interference, non-intervention, non-use of force or threat of force, and the inadmissibility of the acquisition of territory by force. It would encourage support for the convening of a conference on security and cooperation in the region. It would call on regional States to adhere to all the multilaterally negotiated legal instruments for disarmament. They would also be invited to address regional threats posed by terrorism, international crime and illicit arms transfers, as well as illicit drug production, consumption and trafficking.

According to a draft resolution in the report on implementation of the declaration of the Indian Ocean as a Zone of Peace (document A/51/566/Add.17), the Assembly would again state its conviction that participation by all the permanent members of the Security Council and the major maritime users of the ocean in the work of the Ad Hoc Committee on the Indian Ocean would greatly facilitate dialogue to advance peace, security and stability in the region. It would ask the Committee to hold a session of not more than three working days during 1997.

It would call on African States to the NPT to conclude comprehensive safeguards agreements with the IAEA, thereby satisfying a requirement of the Treaty. It would call on relevant States to take all necessary measures to ensure the Treaty's speedy application to territories for which they are internationally responsible or which lie within the geographical zone established in the Treaty.

By a draft resolution in the report on the Biological Weapons Convention (document A/51/566/Add.20), the Assembly would request the Secretary-General to continue assistance to the depositary governments of the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on Their Destruction. It would welcome the convening of the Fourth Review Conference of the Parties to the Convention from 25 November to 6 December 1996, call upon all signatory States to ratify the Convention, and call upon States to become parties to it.

It would stress the importance of good- neighbourliness and friendly relations among States, and affirm the need for strict compliance with the principle of the inviolability of international borders.

The Assembly first took up the report on the prohibition of the development and manufacture of new types of weapons of mass destruction, adopting the resolution without a vote.
The Assembly next took note of the report on reduction of military budgets.
The draft resolution on objective information on military matters contained in that report was adopted without a vote.
The Assembly then took up the report on the role of science and technology in the context of international security and disarmament. The related resolution was adopted by a vote of 105 in favour to 39 against, with 24 abstentions. (For details of the vote see Annex I.)
It adopted a second resolution on science and technology in the context of international security, disarmament and other related fields by a vote of 161 in favour to none against, with 8 abstentions (Democratic People's Republic of Korea, Federated States of Micronesia, India, Iran, Japan, Pakistan, Sri Lanka, United States) (Annex II).
The Assembly took note of the report on the Amendment of the Treaty Banning Nuclear Weapon Tests in the Atmosphere, in Outer Space and under Water, as well as the report on implementation of the CTBT.
The Assembly then took up the report on the establishment of a nuclear- weapon-free zone in the Middle East, adopting the related draft text without a vote.

In a separate vote on operative paragraph 6, the paragraph was adopted by a vote of 117 in favour to 1 against (United States), with 4 abstentions (Annex VI).

ROBERT FOWLER (Canada), speaking before the vote on a resolution contained in that report, on a nuclear-weapon-free Southern hemisphere, said that Canada was a strong supporter of such zones and would have preferred to vote in the First Committee in favour of that text. However, the final text had contained elements which had led Canada to oppose it. Subsequent discussions had revealed that those concerns had now been substantially met, so Canada would abstain.
The Assembly adopted the resolution on the NPT Review Conference and its Preparatory Committee by a vote of 167 in favour to none against, with 2 abstentions (India, Israel) (Annex VIII).

KIM CHANG GUK (Democratic People's Republic of Korea), speaking in explanation of vote after the vote, said he had abstained from voting on the draft on nuclear disarmament with a view to the elimination of nuclear weapons, originally sponsored by Japan, for the same reasons as in previous years. The title and the contents of the resolution were unclear and the resolution did not propose any specific means for the elimination of nuclear weapons. It was, in fact, a typical case of Japanese "double-dealing". Japan made much of its horrendous experience from a nuclear attack. Yet, it was the only country accumulating weapons-grade plutonium. It had not repented for past crimes, and through the resolution it was merely attempting to mask its nuclear ambitions.
The Assembly next took up the six draft resolutions contained in the report on the review and implementation of the concluding document of the twelfth special session (document A/51/566/Add.12).
The draft texts on the Disarmament Information Programme, the Centre for Peace in Asia and the Pacific and regional confidence-building measures were adopted without a vote.
The resolution on a convention to prevent the use of nuclear weapons was adopted by a vote of 114 in favour to 31 against, with 27 abstentions (Annex XXX).
The draft resolutions on the Centre for Peace in Africa and disarmament training and advisory services were adopted without a vote.
The Assembly next took up the resolutions contained in the report on implementation of the recommendations and decisions adopted by the tenth special session of the General Assembly.
The resolution on the membership of the Conference on Disarmament was adopted by a vote of 171 in favour to none against, with 2 abstentions (Turkey, United States) (Annex XXXI).
The texts on the report of the Disarmament Commission and the report of the Conference on Disarmament were adopted without a vote.
The Assembly then took up the text on the risk of nuclear proliferation in the Middle East.

The Assembly adopted a decision on an agenda item on the Declaration on Strengthening International Security by a vote of 118 in favour to none against, with 53 abstentions (Annex XXXVI).
The draft resolution contained in the report on the question of Antarctica was adopted without a vote.
Right of Reply
TOSHIHIRO TAKAHASHI (Japan), speaking in exercise of the right of reply, said that the allegation made by the representative of the Democratic People's Republic of Korea was a malicious exercise in anti-Japanese propaganda. Japan had made it clear that it was determined to conduct a proactive foreign policy that would contribute to the future well-being of mankind. It would do so in the spirit of international cooperation and by prohibiting the use of force.
His Government had pronounced its determination to see that the tragedy it had experienced would never be repeated. His country would strictly uphold its three non-nuclear principles -- of not possessing, producing or introducing into its territory nuclear weapons. The resolution on nuclear disarmament with a view to their ultimate elimination, presented by Japan, was

genuine. He would call on the Democratic People's Republic of Korea to participate more positively in United Nations deliberations.
KIM CHANG GUK (Democratic People's Republic of Korea), speaking in exercise of the right of reply, said that his statement was based on the fact that Japan had not made any settlement for the crimes it had committed in the Second World War. That country was accumulating plutonium by purchasing it from world producers. Japan was not going to apologize for its crimes, and would again commit such crimes against humanity.
PHILIPPE ROLAND (Belgium) said that his delegation would have voted in favour of the United States draft on anti-personnel land-mines, but had been unable to do so because of a technical problem.
