ASSEMBLY STRONGLY DEPLORES ALL NUCLEAR TESTING, URGES IMMEDIATE HALT, CONTINUED MORATORIUMS PENDING ENACTMENT OF COMPREHENSIVE TREATY

The General Assembly this afternoon strongly deplored all current nuclear testing and strongly urged the immediate cessation of all such testing, by a resolution adopted this afternoon on the recommendation of its First Committee (Disarmament and International Security).

By a vote of 85 in favour to 18 against with 43 abstentions, the Assembly commended those nuclear-weapon States observing testing moratoriums and urged them to continue the moratoriums pending the entry into force of a comprehensive nuclear test-ban treaty. (For details of voting, see Annex XIII.)

Acting on the 46 resolutions and three decisions recommended by the Committee, the Assembly dealt with such issues as nuclear and other weapons of mass destruction, conventional arms, regional disarmament, confidence-building and transparency, an outer space arms race, international security, and disarmament bodies.

The Assembly urged all States to support the negotiations in the Conference on Disarmament for a comprehensive nuclear test ban, calling on the Conference to give highest priority to concluding the ban as soon as possible in 1996. Prior to acting without a vote to adopt the text as a whole, the Assembly held a separate vote to adopt its paragraph calling for the treaty to be ready for signature by the outset of the Assembly's next session (Annex VI).

By another text, the Assembly urged all States not yet party to the partial test-ban Treaty to adhere to it. It asked all States parties to contribute to the conclusion of a comprehensive nuclear test ban not later

than 1996. The resolution was adopted by 110 votes in favour to 4 against (Israel, Russian Federation, United Kingdom, United States), with 45 abstentions (Annex V).

The nuclear-weapon States were urged immediately to stop the qualitative improvement, development, stockpiling and production of nuclear warheads and delivery systems, by another text. The Assembly called on them to undertake a phased programme of deep reductions of nuclear weapons, aimed at their total elimination within a time-bound framework. That text was adopted by 106 votes in favour to 39 against, with 17 abstentions (Annex XXXII).

The Assembly urged States not parties to the Treaty on the Non- Proliferation of Nuclear Weapons (NPT) to accede to it at the earliest possible date, by another text. It called for determined efforts by nuclear- weapon States to reduce nuclear weapons, and by all States for general and complete disarmament. The vote was 154 in favour to none against with 10 abstentions (Algeria, Brazil, China, Cuba, Democratic People's Republic of Korea, India, Iran, Israel, Myanmar and Pakistan) (Annex XVII). Prior to adopting the text as a whole, it voted to adopt paragraphs welcoming the decisions of the NPT Review Conference (Annex XV) and urging accession to that Treaty (Annex XVI).

The Assembly decided to convene a fourth special session on disarmament, to be held in 1997 if possible, with the exact date and agenda to be determined by the end of the current session, under a resolution adopted by 111 votes in favour to 2 against (Israel, United States) with 49 abstentions (Annex XXV).

Prior to adopting the text as a whole, the Assembly held separate votes to adopt four of its operative paragraphs. By their terms, the Assembly decided to convene the special session "to be held in 1997, if possible" (Annex XXI); to establish a Preparatory Committee for the special session (Annex XXII); to ask that body to meet briefly before the end of the Assembly's current session to set the date for its substantive session (Annex XXIII) and to submit a progress report to the Assembly at its next session (Annex XXIV).

The Assembly urged the Russian Federation and the United States to resume their bilateral negotiations on preventing an outer space arms race, under another text. By a vote of 121 in favour to none against with 46 abstentions, it called on all States to contribute to preventing such an arms race and asked the Conference on Disarmament to intensify its consideration of the matter (Annex XII.)

Prior to taking that action, separate votes were held to adopt paragraphs recognizing that the fundamental task of the Conference's Ad Hoc Committee was to conclude agreements to prevent an outer space arms race

(Annex IX); asking the Conference to re-establish an ad hoc committee to conclude such an agreement (Annex X); and urging the Russian Federation and the United States to resume their bilateral negotiations on the matter (Annex XI).

The Assembly again urged the States of South Asia to continue their efforts to establish a nuclear-weapon-free zone there and to refrain from any action contrary to that objective, under a resolution adopted by 154 votes in favour to 3 against (Bhutan, India, Mauritius) with 9 abstentions (Algeria, Cuba, Cyprus, Laos, Indonesia, Israel, Madagascar, Myanmar, Viet Nam) (Annex VII).

The Assembly called on Israel and all other Middle Eastern States not yet party to the NPT "not to develop, produce, test or otherwise acquire nuclear weapons, to renounce possession of nuclear weapons and to accede to the Treaty at the earliest date", by another text. They were also asked to place all unsafeguarded nuclear facilities under full-scope International Atomic Energy Agency safeguards. The resolution was adopted by 56 votes in favour to 2 against (Israel, United States), with 100 abstentions (Annex XXXIX).

Prior to adopting the text as a whole, the Assembly voted to adopt a paragraph recalling the decision of the NPT Conference calling on all States to accede to that Treaty (Annex XXXVIII).

By 150 votes in favour to none against with 14 abstentions, the Assembly encouraged the United States, Russian Federation, Belarus, Kazakstan and Ukraine to continue their cooperative efforts aimed at eliminating nuclear weapons and strategic offensive arms on the basis of existing agreements (Annex XXVII). By a separate vote, it adopted a paragraph which notes with appreciation the indefinite extension of the NPT and acknowledges the importance of progressive efforts to reduce nuclear weapons (Annex XXVI).

The Assembly appealed to all States to work towards early agreement on security assurances to non-nuclear-weapon States, including conclusion of a legally binding international instrument, under a resolution adopted by 122 votes in favour to none against, with 44 abstentions (Annex VIII).

It also welcomed the signing of the 1993 Treaty between the Russian Federation and the United States on the Further Reduction and Limitation of Strategic Offensive Arms and urged them to bring it into force at the earliest possible date. By 105 votes in favour to 37 against with 20 abstentions, it encouraged the United States, Russian Federation, Kazakstan and Ukraine to continue their efforts to eliminate nuclear weapons and strategic offensive arms on the basis of existing agreements (Annex XXXI).

By 108 votes in favour to 27 against with 28 abstentions, the Assembly repeated its request that the Conference on Disarmament begin negotiating a convention to prohibit the use or threatened use of nuclear weapons, submitting a draft text to be used as a possible basis for negotiations (Annex XXXVI).

By another text, the Assembly noted that this year's NPT Review Conference had decided, without a vote, to extend the Treaty indefinitely and to continue holding review conferences every five years, and that the parties had agreed to strengthen the Treaty's review process. The vote was 161 votes in favour to none against, with 2 abstentions (India, Israel) (Annex XXXIII).

The Assembly called on all States to conclude agreements for nuclear non-proliferation, disarmament and confidence-building measures at the regional and subregional levels, by a text on regional disarmament. That action was taken by 165 votes in favour to none against with 1 abstention (India) (Annex XXVIII).

The Assembly decided urgently to consider conventional arms control at the regional and subregional levels, under another text. By 158 vote in favour to none against with 7 abstentions (Brazil, Cuba, India, Libya, Mexico, Nigeria and Venezuela), it asked the Conference on Disarmament to consider formulating principles for regional agreements on the matter (Annex XXIX).

By 140 votes in favour to none against with 19 abstentions, the Assembly asked the Secretary-General, assisted by a panel of qualified governmental experts, to report on the types of small arms and light weapons being used in conflicts, the nature and causes of the excessive accumulation and transfer of such arms, and ways to prevent it (Annex XIV).

The Assembly called on States to provide data for the Register of Conventional Arms on their arms imports and exports and on their military holdings and procurements, by a vote of 149 in favour to none against, with 15 abstentions (Annex XX). Prior to adopting the text as a whole, it voted to adopt paragraphs recalling a request that the Secretary-General, assisted by a governmental expert group, report on the operation of the Register (Annex XVIII); and inviting the Conference on Disarmament to consider continuing its work on transparency in armaments (Annex XIX).

By another text, the Assembly asked the Secretary-General to give wide circulation to his report on verification and to report on actions taken to implement its recommendations. The vote was 157 in favour to 1 against (United States) with 6 abstentions (Democratic People's Republic of Korea, France, Georgia, Israel, Monaco and United Kingdom) (Annex I).

States were invited to enhance bilateral and multilateral dialogue on the role of science and technology in international security and disarmament, under a resolution adopted by 157 votes in favour to none against, with 9 abstentions (Cuba, Democratic People's Republic of Korea, France, India, Iran, Japan, Pakistan, United Kingdom and the United States) (Annex XIV).

Under a related text, adopted by 104 votes in favour to 6 against (France, Israel, Luxembourg, Netherlands, United Kingdom and the United States), with 53 abstentions, the Assembly asked the Secretary-General to develop a database of concerned research institutions and experts for the application of science and technology to disarmament (Annex III).

The Assembly restated its conviction that participation of all permanent members of the Security Council and major maritime users of the Ocean in the Ad Hoc Committee on the Indian Ocean would facilitate dialogue towards regional peace and stability, under a resolution adopted by 123 votes in favour to 3 against (France, United Kingdom and United States), with 39 abstentions (Annex XL).

It asked the Conference on Disarmament to include environmental norms in disarmament and arms control agreements and to conclude a comprehensive nuclear test ban as soon as possible in 1996, by 157 votes in favour to 4 against (France, Israel, the United Kingdom and the United States) with 2 abstentions (Canada, Japan) (Annex XXX).

Acting without a vote, the Assembly asked the Secretary-General to provide all necessary support, within existing resources, to the United Nations Regional Centre for Peace and Disarmament in Asia and the Pacific. Prior to adopting that text, it voted separately to adopt a paragraph recommending that the Centre organize scheduled regional meetings in Kathmandu, Hiroshima and other cities in 1996, within available resources (Annex XXXV).

By another resolution adopted without a vote, the Assembly asked the Disarmament Commission to meet for not more than four weeks during 1996 and recommended that it consider the question of international arms transfers. By a separate vote, it asked the Secretary-General to compile all texts of principles, guidelines or recommendations unanimously adopted by the Commission since its inception in 1978 (Annex XXVII).

Acting without a vote, the Assembly also urged the Conference on Disarmament to continue as the highest priority its negotiations to conclude a comprehensive nuclear test-ban treaty; called for urgent implementation of the Conference's decision to expand its membership; urged States of the region that have not yet done so to ratify the amendments to the Treaty on the Prohibition of Nuclear Weapons in Latin America and the Caribbean (Treaty of Tlatelolco); invited the African States to sign and ratify the Treaty on an

African nuclear-weapon-free zone as soon as possible, and called on the nuclear-weapon States to sign its relevant protocols.

In other action, it sought urgent steps to establish a nuclear-weapon- free zone in the Middle East; called on all countries of the region to place their nuclear activities under International Atomic Energy Agency safeguards; and invited them not to develop, produce, test or acquire nuclear weapons; recognized the contribution to nuclear disarmament and to regional and global security made by Belarus, Kazakstan and Ukraine, which voluntarily renounced nuclear weapons, and by South Africa, which voluntarily gave up its nuclear- weapons programme; and called for universal adherence to the biological weapons Convention and for its ratification without delay.

The Assembly also called for steps to prevent any dumping of nuclear or radioactive wastes that would infringe on State sovereignty, and asked the Conference on Disarmament to intensify efforts to conclude a convention banning radiological weapons; encouraged the Secretary-General to continue his efforts to curb the illicit circulation of small arms and to collect arms in affected States of the Sahelo-Saharan subregion which so request; urgently called for universal adherence to the Convention on Indiscriminate Conventional Weapons and its Protocols; asked States parties to intensify efforts to strengthen its land-mines protocol, and commended to all States its protocol on blinding laser weapons.

The Assembly urged a moratorium on the export of anti-personnel land- mines and full compliance with Protocol II of the Indiscriminate Weapons Convention, which concerns such weapons; invited States to take enforcement measures to ensure the immediate discontinuance of illicit arms transfers; urged all States parties to arms limitation and disarmament agreements to comply with all their provisions; appealed for voluntary contributions for the two regional centres for disarmament in Africa and Latin America and the Caribbean; and called on all States of the Mediterranean region to adhere to multilateral disarmament instruments; invited them to address cooperatively such regional problems as terrorism, international crime, illicit arms transfers and illicit drugs; and encouraged them to promote transparency and to provide accurate data to the United Nations Register of Conventional Arms.

The Assembly also urged all Balkan States to normalize their relations and called on them to undertake unilateral and joint activities; supported Turkmenistan's status of permanent neutrality and called on Member States to do the same; asked States and organizations to facilitate the holding of a training programme on peace operations in Central Africa, and asked the Secretary-General to set up a trust fund for additional voluntary contributions for the United Nations Standing Advisory Committee on Security Questions in Central Africa.

In other action, the Assembly asked the Secretary-General to continue implementing the United Nations disarmament fellowship, training and advisory services, within existing resources; invited governments and non-governmental organizations to continue taking an active part in Disarmament Week; and urged the international community to devote part of the resources made available through disarmament to economic and social development.

By two of its three decisions, the Assembly acted to include the following items in the provisional agenda of its next session:

-- "Review of the Implementation of the Declaration on the Strengthening of International Security" -- by 109 votes in favour to none against with 54 abstentions (Annex II);

-- "Non-proliferation of weapons of mass destruction and of vehicles for their delivery in all its aspects" -- by 114 votes in favour to 1 against (United States) with 49 abstentions (Annex XXXIV).

By a third decision, adopted without a vote, it asked the Chairman of the First Committee to continue consultations on further rationalizing that body's work.

The Assembly will meet again at 10 a.m. on Thursday, 14 December, to take up the second report of its Credentials Committee. It will then resume its consideration of agenda item 105, on social development, and take action on a draft resolution contained in a report of the Secretary-General (document A/50/728). It will then take up its agenda item on assistance in mine clearance.

Assembly Work Programme

The General Assembly met this afternoon to take action on 25 reports of the First Committee (Disarmament and International Security), which contain 46 draft resolutions and three draft decisions.

The report of the First Committee on compliance with disarmament obligations (document A/50/577) contains one draft resolution, by which the Assembly would urge all States parties to arms limitation and disarmament agreements to comply with all their provisions. It would call on Member States to support efforts aimed at the resolution of non-compliance questions.

The draft was approved by the Committee on 20 November, as orally amended, without a vote.

The report on education and information for disarmament (document A/50/578) indicates that no action was taken by the First Committee on that item.

On the question of verification (document A/50/579), the Assembly would ask the Secretary-General to give the widest possible circulation to his report on verification and the United Nations role, and would encourage Member States to consider the recommendations contained in it. It would also ask that he report on actions taken by Member States and by the United Nations Secretariat regarding those recommendations.

The draft was approved by the Committee on 15 November by a vote of 140 in favour to 1 against (United States), with 7 abstentions (Democratic People's Republic of Korea, France, Germany, Georgia, Israel, Monaco and United Kingdom).

By a draft decision in the Committee's report on the strengthening of international security (document A/50/580), the Assembly would decide to include in the provisional agenda of its fifty-first session the item entitled "Review of the Implementation of the Declaration on the Strengthening of International Security".

The draft decision was approved in Committee by a vote of 102 in favour to none against, with 52 abstentions.

The report of the Committee on reduction of military budgets (document A/50/581) indicates that no action was taken by the First Committee on that item.

The report on the impact of scientific and technological developments on international security (document A/50/582) contains one draft resolution. By its terms, the Assembly would urge States to undertake multilateral

negotiations to establish guidelines for international transfers of high technology having military applications. It would also ask the Secretary- General to develop a database of concerned research institutions and experts to promote the application of science and technology to disarmament objectives.

The Assembly would further affirm that scientific and technological achievements should be used for the benefit of all mankind and that the transfer and exchange of technological know-how for peaceful purposes should be promoted.

The draft was approved by the Committee on 16 November by a vote of 98 in favour to 6 against (France, Israel, Luxembourg, Netherlands, United Kingdom and the United States), with 51 abstentions.

The report on the role of science and technology in international security and disarmament (document A/50/583) also contains one draft resolution. It would have the Assembly invite Member States to enhance bilateral and multilateral dialogue on the role of science and technology in international security, disarmament and related fields. Such dialogue would aim at ensuring implementation of international legal commitments and at exploring ways of further developing international legal rules on transfers of high technology having military applications.

The draft was approved by the Committee on 16 November by a vote of 148 in favour to none against, with 9 abstentions (Cuba, Democratic People's Republic of Korea, France, India, Iran, Japan, Pakistan, United Kingdom and the United States).

The report of the Committee on amendment of the Treaty Banning Nuclear Weapon Tests in the Atmosphere, in Outer Space and under Water (the partial test-ban Treaty) (document A/50/584) also contains one resolution. By its terms, the Assembly would urge all States not yet party to the Treaty to adhere to it. All parties would be asked to contribute to the conclusion of a comprehensive nuclear test-ban treaty as soon as possible and not later than 1996.

The draft was approved by the Committee on 10 November by a vote of 95 in favour to 4 against (Israel, Russian Federation, United Kingdom, United States), with 44 abstentions.

By a resolution in the report on a comprehensive test-ban treaty (document A/50/585), the Assembly would urge all States to support the negotiations in the Conference on Disarmament for a comprehensive nuclear test ban. The Assembly would call on all States participating in the Conference, particularly the nuclear-weapon States, to give the highest priority to concluding a universal and verifiable ban, to be opened for signature by the

outset of the Assembly's next session. It would also call on the Conference to re-establish its relevant ad hoc committee, so as to complete the treaty as soon as possible in 1996.

The draft was approved by the Committee on 17 November without a vote.

Prior to approval of the text as a whole, its operative paragraph 2, which calls for the treaty to be ready for signature by the outset of the Assembly's next session, was approved by 161 votes in favour to none against, with 1 abstention (China).

The General Assembly would urge all parties directly concerned to consider taking urgent steps to establish a nuclear-weapon-free zone in the Middle East, according to a draft resolution in the Committee's report on that subject (document A/50/586). As a means to that end, the Assembly would invite them to adhere to the Treaty on the Non-Proliferation of Nuclear Weapons.

Pending establishment of such a zone, the Assembly would call on all countries of the region to agree to place all their nuclear activities under International Atomic Energy Agency (IAEA) safeguards. It would invite them not to develop, produce, test or otherwise acquire nuclear weapons or permit their stationing on their territories.

The draft was approved by the Committee on 13 November without a vote.

By a draft resolution in the report on a nuclear-weapon-free zone in South Asia (document A/50/587), the Assembly would once again urge the States of the region to continue making all possible efforts to establish such a zone there. It would ask the South Asian States to refrain from any action contrary to that objective. It would also ask the Secretary-General to report on consultations with States of the region that have explored ways of furthering the goal of a nuclear-weapon-free zone.

The draft was approved by the Committee on 10 November by a vote of 133 in favour to 3 against (Bhutan, India, Mauritius) with 11 abstentions.

The Assembly would appeal to all States to work towards early agreement on security assurances to non-nuclear-weapon States, including conclusion of a legally binding international instrument, by a draft resolution in the Committee's report on that subject (document A/50/588). It would recommend to the Conference on Disarmament that it continue intensive negotiations to reach early agreement on such assurances, taking into account the widespread support for the conclusion of an international convention.

The draft was approved by the Committee on 14 November by a vote of 113 in favour to 1 against (Swaziland, later announced as an error), with 42 abstentions.

The Assembly would urge the Russian Federation and the United States to resume their bilateral negotiations, in order to reach early agreement on preventing an outer space arms race, according to a draft in the Committee's report on preventing such an arms race (document A/50/589). The Assembly would also call on all States to contribute to preventing an outer space arms race and would ask the Conference on Disarmament to intensify its consideration of the matter, with a view to concluding an agreement or agreements.

The draft was approved by the Committee on 15 November by a vote of 113 in favour to none against, with 46 abstentions.

Prior to approval of the draft resolution as a whole, separate votes were taken on the nineteenth preambular paragraph, as well as on operative paragraphs 8 and 10.

The nineteenth preambular paragraph -- which recognizes that there had been agreement in the Ad Hoc Committee of the Conference on Disarmament that the conclusion of international agreement to prevent an outer space arms race remained the Committee's fundamental task -- was approved by 99 votes in favour to 1 against (United States), with 55 abstentions.

Operative paragraph 8 -- which requests the Conference to re-establish an ad hoc committee with an adequate mandate, with a view to undertaking negotiations to conclude such an agreement or agreements -- was approved by 100 votes in favour to 1 against (United States), with 55 abstentions.

Operative paragraph 10 -- which urges the Russian Federation and the United States to resume their bilateral negotiations with a view to reaching early agreement on preventing an arms race in outer space -- was approved by 91 votes in favour to 1 against (United States), with 63 abstentions.

The report of the First Committee on general and complete disarmament (document A/50/590) contains 18 draft resolutions and 1 draft decision.

By the draft decision, the Assembly would include in the provisional agenda of its next session an item entitled "Non-proliferation of weapons of mass destruction and of vehicles for their delivery in all its aspects".

The draft decision was approved on 10 November by a vote of 102 in favour to 1 against (United States) with 45 abstentions.

The General Assembly would strongly deplore all current nuclear testing and strongly urge the immediate cessation of all testing, by draft resolution A. By other terms of the text on a halt to nuclear testing, the Assembly would commend those nuclear-weapon States observing testing moratoriums and urge them to continue such moratoriums pending the entry into force of a comprehensive nuclear test-ban treaty.

The draft was approved by the Committee on 16 November by a vote of 95 in favour to 12 against with 45 abstentions.

The Assembly would ask the Secretary-General to report on the types of small arms and light weapons being used in conflicts, the nature and causes of the excessive accumulation and transfer of such arms, and ways to prevent it, by draft resolution B. According to the text, the Secretary-General would prepare his report with the assistance of a panel of qualified governmental experts, to be nominated on the basis of equitable geographical distribution.

The draft was approved by the Committee on 20 November, as orally amended, by 134 votes in favour to none against with 16 abstentions.

Prior to approval of the text as a whole, an amendment by which the Assembly would reaffirm the right to self-determination of all peoples, particularly those under colonial or other forms of alien domination or foreign occupation, was approved by 54 votes in favour to none against, with 88 abstentions.

By draft resolution C, on nuclear disarmament and the elimination of nuclear weapons, the Assembly would urge States not parties to the Non- Proliferation Treaty to accede to it at the earliest possible date. It would call for determined pursuit by the nuclear-weapon States of progressive efforts to reduce nuclear weapons globally, with the ultimate goal of their elimination, and the pursuit by all States of general and complete disarmament.

The draft was approved by the Committee on 17 November by a vote of 144 in favour to none against, with 13 abstentions.

Prior to approval of the text as a whole, separate votes were held on its fifth preambular paragraph, which welcomes decisions taken at the NPT Review Conference, and operative paragraph 1, which urges accession to the Non-Proliferation Treaty. The fifth preambular paragraph was approved by 135 votes in favour to none against, with 19 abstentions. Operative paragraph 1 was approved by 146 votes in favour to 2 against (India, Israel), with 7 abstentions (Algeria, Brazil, Cuba, Myanmar, Namibia, Nigeria and Pakistan).

By draft resolution D, on transparency in armament, the Assembly would call upon Member States to provide data for the Register of Conventional Arms on their imports and exports of arms, as well as on their military holdings and procurement. It would also ask the Secretary-General to ensure that sufficient resources were made available for the operation and maintenance of the Register.

The draft was approved by the Committee on 15 November by a vote of 137 in favour to none against, with 15 abstentions.

Prior to adoption of the text as a whole, separate votes were held on two operative paragraphs. Paragraph 3 (b) recalls a request that the Secretary-General, with the assistance of a group of governmental experts, report on continuing operation of the Register. It was approved by 133 votes in favour to none against, with 12 abstentions. Paragraph 5, which invites the Conference on Disarmament to consider continuing its work undertaken in the field of transparency in armaments, was approved by 133 votes in favour to none against, with 15 abstentions.

The Assembly would call on all States to take appropriate measures to prevent any dumping of nuclear or radioactive wastes that would infringe on the sovereignty of States, by draft resolution E. The Conference on Disarmament would be asked to intensify efforts towards an early conclusion of a convention banning radiological weapons, and to take account of the question of radioactive wastes as part of the scope of such a convention.

The draft was approved on 10 November without a vote.

By draft resolution F, the Assembly would decide to convene a fourth special session on disarmament, to be held in 1997 if possible, with the exact date and agenda to be determined before the end of the current session. It would establish a Preparatory Committee to prepare a draft agenda and examine all relevant questions concerning the session. It would also invite all States to communicate their views on the matter to the Secretary-General not later than April 1996.

The draft was approved by the Committee on 21 November by a vote of 98 in favour to 2 against (Israel, United States), with 46 abstentions.

Prior to approval of the draft resolution as a whole, separate recorded votes were held on its operative paragraphs 1, 2, 4 and 5.

Operative paragraph 1, by which the Assembly would decide to convene the special session "to be held in 1997, if possible", was approved by 96 votes in favour to 39 against with 10 abstentions (Armenia, Azerbaijan, Belarus, Japan, Kazakstan, Paraguay, Peru, Republic of Korea, Russian Federation and Ukraine).

Operative paragraph 5, by which the Assembly would ask the Preparatory Committee to submit its progress report to the Assembly at its next session, was approved by 95 votes in favour to 39 against with 11 abstentions.

Prior to taking any action on the text, the Committee approved a "non- action" motion on a series of amendments proposed by the United States. The motion was approved by 88 votes in favour to 47 against with 7 abstentions (El Salvador, Guatemala, Honduras, Nicaragua, Panama, Peru and Uruguay).

By draft resolution G, on the relationship between disarmament and development, the international community would be urged to devote part of the resources made available through disarmament to economic and social development. The Secretary-General would be asked to continue to take action to implement the action programme adopted at the International Conference on the Relationship between Disarmament and Development.

The draft was approved by the Committee on 10 November without a vote.

The Assembly would encourage the Secretary-General to continue his efforts to curb the illicit circulation of small arms and to collect such arms in affected States of the Sahelo-Saharan subregion which so request, by draft resolution H on illicit traffic in small arms. It would also invite States to implement national control measures to check the illicit circulation of small arms, in particular by curbing their illegal export.

The Assembly would encourage the United States, Russian Federation, Belarus, Kazakstan and Ukraine to continue their cooperative efforts aimed at eliminating nuclear weapons and strategic offensive arms on the basis of existing agreements, by draft I, on bilateral arms negotiations and nuclear disarmament. It would also support those countries in their efforts to reduce their nuclear weapons and invite them to keep other States informed of their progress to that end.

That paragraph was approved by 116 votes in favour to none against with 29 abstentions.

By draft resolution J, on illicit arms transfer and the use of conventional arms, the Assembly would invite Member States to take appropriate enforcement measures to ensure that illicit arms transfers are immediately discontinued. It would invite them to provide the Secretary-General with information on national control measures on arms transfers and would ask the Disarmament Commission to expedite its consideration of international arms transfers.

Draft resolution K, on regional disarmament, would have the Assembly call on all States to conclude agreements for nuclear non-proliferation, disarmament and confidence-building measures at the regional and subregional levels. It would also support and encourage efforts aimed at promoting confidence-building at regional and subregional levels.

The draft was approved by the Committee on 15 November by a vote of 156 in favour to none against with 1 abstention (India).

By draft resolution L, on conventional arms control at the regional and subregional levels, the Assembly would decide to give urgent consideration to the matter. It would ask the Conference on Disarmament, as a first step, to consider formulating principles to serve as a framework for regional agreements on conventional arms control.

The draft was approved by the Committee on 15 November by a vote of 150 in favour to none against with 7 abstentions (Brazil, Cuba, India, Libya, Mexico, Nigeria and Venezuela).

The Assembly would ask the Conference on Disarmament to include environmental norms in disarmament and arms control agreements and to conclude a comprehensive nuclear test-ban treaty as soon as possible in 1996, by draft resolution M. The Assembly would call on States parties to the chemical weapons Convention to ensure that its implementation was environmentally sound. It would urge all States parties to the biological weapons Convention to consider environmental protection norms in implementing that Convention.

By draft resolution N, on bilateral nuclear arms negotiations, the Assembly would welcome the signing of the 1993 Treaty between the Russian Federation and the United States on the Further Reduction and Limitation of Strategic Offensive Arms on 3 January 1993, and would urge the parties to bring it into force at the earliest possible date.

Other terms of that text would encourage the United States, the Russian Federation, Kazakstan and Ukraine to continue their cooperative efforts aimed at eliminating nuclear weapons and strategic offensive arms on the basis of existing agreements.

The draft was approved by the Committee on 15 November by a vote of 95 in favour to 37 against, with 22 abstentions.

By draft resolution O, the Assembly would urge States that have not yet done so to declare a moratorium on the export of anti-personnel land-mines. It would urge all States immediately to comply fully with Protocol II of the Convention on Indiscriminate Conventional Weapons -- which addresses such weapons as land-mines -- and would ask the Secretary-General to report on steps taken by Member States to implement land-mine moratoriums.

The draft was approved by the Committee on 17 November without a vote.

By draft resolution P, on nuclear disarmament, the Assembly would urge the nuclear-weapon States to stop immediately the qualitative improvement, development, stockpiling and production of nuclear warheads and delivery systems. It would call on those States to undertake a phased programme of deep reductions of nuclear weapons, with a view to their total elimination within a time-bound framework. The Conference on Disarmament would be called on to establish an ad hoc committee to begin negotiations on a phased programme.

The draft was approved by the Committee on 16 November by a vote of 99 in favour to 39 against, with 15 abstentions.

By draft resolution Q, on the NPT Review and Extension Conference, the Assembly would note that the States parties to the Non-Proliferation Treaty (NPT) decided this year, without a vote, to extend the Treaty indefinitely and to continue holding review conferences every five years. The Assembly would

The Assembly would recognize the significant contribution to nuclear disarmament and to regional and global security made by Belarus, Kazakstan and Ukraine -- which have voluntarily renounced nuclear weapons -- and by South Africa, which has voluntarily given up its nuclear-weapons programme, under draft resolution R. It would acknowledge that Ukraine's decision, as well as decisions taken by Belarus and Kazakstan, had contributed to the entry into force of the Treaty on the Reduction and Limitation of Strategic Offensive Arms (START I).

The First Committee's report (document A/50/591) on implementation of the concluding document of the twelfth special session of the Assembly -- the second devoted to disarmament -- contains five draft resolutions.

By draft resolution A, on United Nations disarmament fellowship, training and advisory services, the Assembly would ask the Secretary-General to continue implementing the Geneva-based programme within existing resources. It would also commend him for the diligence with which the programme has been carried out.

The draft was approved by the Committee on 10 November without a vote.

By draft resolution B, on regional confidence-building measures, the Assembly would ask States and governmental and non-governmental organizations to facilitate the holding of a training programme on peace operations in the Central African subregion. It would ask the Secretary-General to continue providing assistance to States members of the United Nations Standing Advisory Committee on Security Questions in Central Africa and to establish a trust fund for additional voluntary contributions for the Committee's work.

The draft was approved by the Committee on 20 November without a vote.

The Assembly would appeal once again to States and to international organizations to make substantial voluntary contributions in order to revitalize the two regional centres for disarmament in Africa and Latin America and the Caribbean, by draft resolution C. It would ask the Secretary- General to explore new alternative ways to continue providing all necessary support to the regional centres in fulfilling their mandates.

The Assembly would restate its request to the Conference on Disarmament to begin negotiations to reach agreement on an international convention prohibiting the use or threatened use of nuclear weapons under any circumstances, by draft resolution E. It would state that the Conference could take as a possible basis a draft convention on the prohibition of the use of nuclear weapons, annexed to the draft resolution.

The draft was approved by the Committee on 10 November by a vote of 95 in favour to 26 against, with 26 abstentions.

Another First Committee report concerns implementation of the recommendations and decisions adopted by the Assembly at its tenth special session -- the second devoted to disarmament (document A/50/592). It contains four draft resolutions.

By draft resolution A, on the report of the Conference on Disarmament, that body would be urged to continue as the highest priority its negotiations to conclude a comprehensive nuclear test-ban treaty. The Assembly would also ask the Secretary-General to continue providing the Conference with adequate administrative, substantive and support services.

The draft was approved by the Committee on 10 November without a vote.

The Assembly would invite governments and international and national non-governmental organizations to continue taking an active part in Disarmament Week, by draft resolution B. It would invite the Secretary-

General to continue using United Nations information organs to promote better understanding among the world public of disarmament problems and of the aims of the Week.

By draft resolution C, on expanding the Conference on Disarmament, the Assembly would call for urgent implementation of the decision by the Conference to expand its membership. It would strongly urge that the new members all assume membership together at the start of its 1996 session. It would also urge that the Conference consider the other candidatures to date at that session.

Draft resolution D concerns the report of the Disarmament Commission. By its terms, the Assembly would ask that the Commission meet for a period not exceeding four weeks during 1996 and would recommend that it consider international arms transfers during its 1996 session. In addition, the Secretary-General would be asked to compile all texts of principles, guidelines or recommendations unanimously adopted by the Commission since its inception in 1978.

Prior to approval of the draft resolution as a whole, a separate vote was held on operative paragraph 12, which asks the Secretary-General to prepare the compilation in question. The paragraph was approved by 147 votes in favour to none against, with 3 abstentions (Israel, United Kingdom and United States).

The Assembly also had before it the Committee's report on the risk of nuclear proliferation in the Middle East (document A/50/593), which contains one draft resolution. By its terms, the Assembly would call on Israel and all other States of the region not yet party to the NPT "not to develop, produce, test or otherwise acquire nuclear weapons, to renounce possession of nuclear weapons and to accede to the Treaty at the earliest date". They would also be asked to place all unsafeguarded nuclear facilities under full-scope International Atomic Energy Agency safeguards.

The draft was approved by the Committee on 17 November by a vote of 51 in favour to 4 against (Guatemala, Israel, Lesotho and United States), with 88 abstentions.

Prior to approval of the text as a whole, a separate vote was held on its sixth preambular paragraph, which recalls the decision of the NPT Conference by which it urged universal adherence to the Treaty and called on

all States to accede to it. That paragraph was approved by 109 votes in favour to 3 against (Guatemala, India and Israel), with 27 abstentions.

Another First Committee report concerns the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons Which May Be Deemed to Be Excessively Injurious or to Have Indiscriminate Effects (Convention on Indiscriminate Conventional Weapons) (document A/50/594).

By a draft resolution contained in that report, the Assembly would urgently call on all States to become parties to the Convention and its Protocols as soon as possible. It would ask States parties to intensify efforts to conclude negotiations on a strengthened Protocol II, concerning land-mines, booby traps and other devices. It would also commend the Protocol on Blinding Laser Weapons to all States, with a view to achieving the widest possible adherence at an early date.

The report on strengthening security and cooperation in the Mediterranean region (document A/50/595) contains one draft resolution. It would have the Assembly call on all States of the region to adhere to the multilaterally negotiated legal instruments relating to disarmament. Those States would be invited to address cooperatively such regional problems as terrorism, international crime, illicit arms transfers and illicit drug production, consumption and trafficking. They would also be encouraged to strengthen confidence-building by promoting transparency and by providing accurate data to the United Nations Register of Conventional Arms.

The draft was approved by the Committee on 10 November without a vote.

Another report, on the Indian Ocean as a zone of peace (document A/50/596), contains one draft resolution. By its terms, the Assembly would restate its conviction that participation of all permanent members of the Security Council and major maritime users of the Indian Ocean in the work of the Ad Hoc Committee on the Indian Ocean would greatly facilitate the development of a mutually beneficial dialogue towards peace, security and stability in the region. The Assembly would ask the Secretary-General to continue rendering all necessary assistance to the Ad Hoc Committee.

The draft was approved by the First Committee on 15 November by a vote of 115 in favour to 3 against (France, United Kingdom and United States), with 38 abstentions.

The Assembly also had before it the Committee's report on the Treaty on the Prohibition of Nuclear Weapons in Latin America and the Caribbean (Treaty of Tlatelolco) (document A/50/597). It would have the Assembly urge the countries of the region that had not yet done so to ratify the amendments to

the Treaty. It would also welcome the steps taken by several countries of the region during the past year for the consolidation of the regime of military denuclearization established by the Treaty.

The Committee's report on the final text of the Treaty on an African nuclear-weapon-free zone (the Pelindaba treaty) (document A/50/598) also contains one draft resolution. By its terms, the Assembly would invite the African States to sign and ratify the final text of the Treaty as soon as possible, and would call on the nuclear-weapon States to sign its relevant protocols as soon as they became available for signature. The Assembly would ask the Secretary-General to extend assistance to the African States in 1996, within existing resources, to achieve the aims of the draft.

The draft was approved by the Committee on 20 November without a vote.

The Assembly would ask the Chairman of the First Committee to continue consultations on further rationalizing the First Committee's work, with a view to further improvement of its effective functioning, by a draft decision contained in another report (A/50/599). It would decide to defer the agenda item on rationalization of the Committee's work and reform of its agenda to the Assembly's next session.

The draft decision was approved on 13 November without a vote.

The Assembly also had before it a draft resolution contained in the Committee's report on the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on Their Destruction (Biological Weapons Convention) (document A/50/600). By its terms, the Assembly would call for universal adherence to the Convention. It would call on all signatory States to ratify the Convention without delay. It would call on those States that had not signed it to become parties to the Convention at an early date.

The First Committee's report on the maintenance of international security (document A/50/601) contains two draft resolutions.

By draft resolution A, the Assembly would recognize and support Turkmenistan's status of permanent neutrality and would call on Member States to do the same. It would also call on them to respect Turkmenistan's independence, sovereignty and territorial integrity.

The Assembly took note of the Committee's report on education and information for disarmament.

The Assembly then took up the report on verification, adopting the related resolution by a vote of 157 in favour to 1 against (United States), with 6 abstentions (Democratic People's Republic of Korea, France, Georgia, Israel, Monaco and United Kingdom). (For details of voting, see Annex I.)

The decision in the Committee's report on the strengthening of international security was adopted by a vote of 109 in favour to none against, with 54 abstentions. (See Annex II.)

The Assembly then took note of the report on the reduction of military budgets, which contains no recommendations.

The resolution in the report on the impact of scientific and technological developments on international security was adopted by a vote of 104 in favour to 6 against (France, Israel, Luxembourg, Netherlands, United Kingdom and the United States), with 53 abstentions. (Annex III.)

The resolution in the report on the role of science and technology in international security and disarmament was adopted by a vote of 157 in favour to none against, with 9 abstentions (Cuba, Democratic People's Republic of Korea, France, India, Iran, Japan, Pakistan, United Kingdom and the United States). Separate votes were called for on its nineteenth preambular paragraph, as well as on operative paragraphs 8 and 10.

The nineteenth preambular paragraph -- which recognizes that there had been agreement in the Ad Hoc Committee of the Conference on Disarmament that the conclusion of an international agreement to prevent an outer space arms race remained the Committee's fundamental task -- was adopted by 106 votes in favour to 1 against (United States), with 57 abstentions. (Annex IX.)

Operative paragraph 8 -- which requests the Conference to re-establish an ad hoc committee with an adequate mandate, with a view to undertaking negotiations to conclude such an agreement or agreements -- was adopted by 108 votes in favour to 1 against (United States), with 57 abstentions. (Annex X.)

Operative paragraph 10 -- which urges the Russian Federation and the United States to resume their bilateral negotiations with a view to reaching early agreement on preventing an arms race in outer space -- was adopted by 99 votes in favour to 1 against (United States), with 64 abstentions. (Annex XI.)

The resolution as a whole was adopted by a vote of 121 in favour to none against, with 46 abstentions. (Annex XII.)

M. SNELL (Canada), in explanation of vote, said Canada's abstention on the outer space resolution did not represent a lessening of its commitment to preventing an outer space arms race. However, the Conference on Disarmament should focus on concluding its negotiations on a comprehensive nuclear test- ban treaty. Canada could not support establishment of an ad hoc committee on outer space at this time.

The Assembly then turned to the Committee's report on general and complete disarmament, which contains 18 draft resolutions and 1 draft decision.

JOSE EDUARDO MARTINS FELICIO (Brazil), explaining his position on the Treaty on the Non-Proliferation of Nuclear Weapons (NPT) text, said his country was a participant in legally binding non-proliferation commitments in the context of the Treaty of Tlatelolco and other instruments. However, it would not participate in the voting, since the text concerned only the States parties to the NPT.

Mr. DLAMINI (Swaziland) said his delegation had been awaiting instructions from its capital when the Committee considered this text. It was now ready to take action on the matter.

General Assembly Plenary - 19 - Press Release GA/9035 90th Meeting (PM) 12 December 1995

ALAIN DEJAMMET (France), said the nuclear testing text was "unfounded, unfair, pernicious and useless". France had been among the first to support a zero option on nuclear testing. It would continue to pursue that objective. To uphold that objective, France had to acquire a system which would enable it to verify the reliance of its deterrent capability without having to resort to further testing, however limited. France would conclude its testing programme shortly. In doing so, his country was respecting its international commitments. It was not taking any action which was harmful to the environment. The draft resolution had no legal foundation.

The Director-General of the IAEA had supported France's request for the setting up of an expert body to determine the harmlessness of France's testing programme, he said. France would work for the signing of the comprehensive test-ban treaty in 1996, and for nuclear non-proliferation.

JOSEPH CASSAR (Malta), speaking on the same text, said his country strongly supported all measures aimed at nuclear disarmament. It welcomed the indefinite extension of the NPT, and the efforts by the nuclear-weapon States to conclude a comprehensive test-ban treaty. It took note of statements by a nuclear-weapon State that it would conclude its tests before the date set for completion of the comprehensive test ban. In supporting the current text, Malta expressed reservations on preambular paragraph 4, which did not correctly reflect the undertakings by the parties to the NPT at their 1995 Review Conference.

EGIDIUS HAKWENYE (Namibia) said his delegation had received improper instructions on the draft resolution on nuclear testing.

The Assembly then took action on draft resolution A, on a halt to nuclear testing.

MOHAMED AL-HASSAN (Oman) said his delegation had mistakenly participated in the voting on draft resolution A, and wished its non-participation could be reflected in the record.

Mr. DEJAMMET (France), speaking on a point of order, said the order of votes being announced was not the same as in the Committee's report. If the vote was on nuclear testing, that should be specifically stated by the President. Another vote should be taken on the text.

The PRESIDENT said the Assembly was voting on draft resolution A, on a halt to nuclear testing. If any delegation wished to change its vote, the machine was still open.

Mr. AL-HASSAN (Oman) fully supported France's statement. Owing to the discrepancy in the order of the votes, his delegation had mistakenly taken

part. If another vote was taken, with a clear indication of what was being voted on, Oman would not participate.

MANUEL COUTO DE MATOS (Cape Verde) supported the statement of Oman. Once a delegation's participation was registered, it was not possible to remove that, and his delegation had not intended to participate.

MUBARAK ATTIA (Libya) said he had voted correctly, but asked that the President refer to the resolution number as indicated by the First Committee.

Mr. DLAMINI (Swaziland) said he supported the President's position.

The PRESIDENT said the only problem concerned those delegations which had inadvertently participated in the vote. So far, two delegations had indicated that was the case. That could be reflected in the results of the vote. Was there any other delegation to which that applied? He could see none.

Draft resolution A, on a halt to nuclear testing, was adopted by a vote of 85 in favour to 18 against with 43 abstentions. (Annex XIII.)

The Assembly then turned to draft resolution B, on small arms, adopting it by a vote of 140 in favour to none against, with 19 abstentions. (Annex XIV.)

The Assembly then turned to draft resolution C, on nuclear disarmament and the elimination of nuclear weapons.

Separate votes were called for on its fifth preambular paragraph, which welcomes decisions taken at the NPT Review Conference, and operative paragraph 1, which urges accession to the Non-Proliferation Treaty.

HICHAM HAMDAN (Lebanon) said his delegation had voted in favour on the text on small arms. It had not intended to participate in the voting.

The fifth preambular paragraph was adopted by 143 votes in favour to none against, with 17 abstentions. (Annex XV.)

Operative paragraph 1 was adopted by 156 votes in favour to 2 against (India, Israel), with 4 abstentions (Brazil, Cuba, Namibia and Pakistan). (Annex XVI.)

Mr. HAMDAN (Lebanon) said he had not participated in the voting on the fifth preambular paragraph. He had intended to abstain.

Draft resolution E, on dumping of nuclear or radioactive wastes, was adopted without a vote.

The Assembly then turned to draft resolution F, on a fourth special session on disarmament.

Separate votes were requested on its operative paragraphs 1, 2, 4 and 5.

Operative paragraph 1, by which the Assembly would decide to convene the special session "to be held in 1997, if possible", was adopted by 109 votes in favour to 40 against with 12 abstentions. (Annex XXI.)

Operative paragraph 2, by which the Assembly would decide to establish a Preparatory Committee for the special session, was adopted by 109 votes in favour to 41 against with 10 abstentions (Armenia, Azerbaijan, Belarus, Japan, Kazakstan, Paraguay, Peru, Republic of Korea, Russian Federation and Ukraine). Draft resolution J, on illicit arms transfer and the use of conventional arms, was adopted without a vote.

HUMBERTO RIVERO ROSARIO (Cuba) said he voted in favour of the text on the NPT, taking into consideration that its contents were factual in nature. His delegation's vote in favour in no way should be interpreted as changing its substantive position regarding the NPT, to which Cuba is not a party. He asked, through the President, that the Secretariat correct an error in the Spanish version of the report on regional disarmament. Cuba had voted in favour of that text.

MOHAMMAD JUSUF (Indonesia) said that on draft resolution B on small arms, Indonesia had voted in favour but had intended to abstain. On draft resolution K on regional disarmament, it had not participated but intended to vote in favour.

Mr. HAMDAN (Lebanon) said the record should indicate that Lebanon's vote in favour of draft resolution I should be recorded as "in favour" instead of as an abstention. It intended to abstain on the fifth preambular paragraph of draft resolution C. It had not intended to participate on draft resolution E.

DAVID ETUKET (Uganda) said he had intended to vote in favour of the fifth preambular paragraph of draft resolution C.

Mr. AL-HASSAN (Oman) asked for the Arabic text of the Committee's report to be corrected to match the English text, which correctly indicated his delegation's vote.

OSCAR GARCIA (Venezuela) referred to page 30 of the Committee's report. Venezuela voted in favour of L.38. That was not reflected in the First Committee's report.

The Assembly then turned to the report of the First Committee on the recommendations and decisions of the Assembly's tenth special session -- the second devoted to disarmament -- which contains four draft resolutions.

The sixth preambular paragraph was adopted by 122 votes in favour to 2 against (India, Israel), with 27 abstentions. (Annex XXXVIII.)

The draft resolution as a whole was adopted by 56 votes in favour to 2 against (Israel, United States), with 100 abstentions. (Annex XXXIX.)

PETER RIDER (New Zealand) said his delegation supported the text because of its concerns about the risk of nuclear proliferation in the Middle East. He reaffirmed the importance of universal adherence to the NPT, and called on all States of the region to adhere to it. It was inappropriate that the resolution singled out Israel in that regard.

ALEG LAPTSENAK (Belarus) confirmed his abstention in the vote on the resolution as a whole and indicated that he had intended to vote in favour of preambular paragraph 6, and said that should be reflected in the record.

The resolution in the Committee report on the Convention on Indiscriminate Conventional Weapons was adopted without a vote.

The resolution in the report on strengthening security and cooperation in the Mediterranean region was adopted without a vote.

The resolution in the report on the Indian Ocean as a zone of peace was adopted by a vote of 123 in favour to 3 against (France, United Kingdom and United States), with 39 abstentions. (Annex XL.)
