SECURITY COUNCIL COMMITTEE ESTABLISHED PURSUANT TO RESOLUTION 1160 (1998) LAUNCHES ITS SECOND APPEAL

At its third meeting, on 19 August 1998, the Security Council Committee established pursuant to resolution 1160 (1998) took note with appreciation that the following States reported to the Committee pursuant to paragraph 12 of Security Council resolution 1160 (1998) on the steps they had taken to give effect to the prohibitions imposed by that resolution (doc.S/AC.35/ 1998/1- 49): Albania, Armenia, Australia, Austria, Bahrain, Belarus, Belgium, Brazil, Bulgaria, Chile, Cyprus, Czech Republic, Fiji, Finland, France, Germany, Greece, Hungary, Iran (Islamic Republic of), Italy, Japan, Kenya, Korea (Republic of), Latvia, Liechtenstein, Lithuania, Malaysia, Malta, Monaco, New Zealand, Norway, Poland, Portugal, Romania, Saudi Arabia, Singapore, Slovakia, Slovenia, South Africa, Spain, Sweden, Switzerland, the former Yugoslav Republic of Macedonia, Turkey, Ukraine, United Kingdom of Great Britain and Northern Ireland, United States, Thailand and Uruguay.

The Committee, in pursuance of its mandate and in accordance with the guidelines for the conduct of its work, also decided to renew its appeal of 7 May 1998 (SC/6512) to all States, international and regional organizations to provide information on violations or suspected violations of the prohibitions imposed by Security Council resolution 1160 (1998). The following appeal has been issued today by the Chairman of the Security Council Committee established pursuant to resolution 1160 (1998), Ambassador Celso L.N.Amorim (Brazil), on behalf of the Committee:

Appeal to all States, international and regional organizations to provide information on violations or suspected violations of the prohibitions imposed by Security Council resolution 1160 (1998)

1. On 31 March 1998, acting under Chapter VII of the Charter of the United Nations, the Security Council imposed the prohibitions contained in paragraph 8 of resolution 1160 (1998). In paragraph 10 of the resolution, the Council called upon all States, international and regional organizations to act strictly in conformity with the resolution. Paragraphs 8 and 10 of the resolution, respectively, read as follows:

"The Council...

8. Decides that all States shall, for the purposes of fostering peace and stability in Kosovo, prevent the sale or supply to the Federal Republic of Yugoslavia, including Kosovo, by their nationals or from their territories or using their flag vessels and aircraft, of arms and related matériel of all types, such as weapons and ammunition, military vehicles and equipment and spare parts for the aforementioned, and shall prevent arming and training for terrorist activities there;

...

"10. Calls upon all States and all international and regional organizations to act strictly in conformity with this resolution, notwithstanding the existence of any rights granted or obligations conferred or imposed by any international agreement or of any contract entered into or any license or permit granted prior to the entry into force of the prohibitions imposed by this resolution, and stresses in this context the importance of continuing implementation of the Agreement on Subregional Arms Control signed in Florence on 14 June 1996."

By paragraph 9 of the above resolution, the Council decided to establish a committee, consisting of all the members of the Council, to undertake various tasks, inter alia, to seek from all States information regarding the action taken by them concerning the effective implementation of the prohibitions imposed by the resolution and to consider any information brought to its attention by any State concerning violations of the prohibitions imposed by the resolution and to recommend appropriate measures in response thereto and to report on its work to the Council with its observations and recommendations.

3. The Committee urges all States, international and regional organizations to provide information that may be available to them, come across, or will be actively seeking, through legitimate inquiry or activity, concerning violations or suspected violations of the above prohibitions imposed by Security Council resolution 1160 (1998).
