FREE DETERMINATION OF POLITICAL STATUS FOR NON-SELF-GOVERNING TERRITORIES SUBJECT OF TEXT APPROVED BY FOURTH COMMITTEE

The General Assembly would reaffirm that the people in the remaining 12 Non-Self-Governing Territories must ultimately determine freely their political status, according to a draft resolution approved this afternoon by the Fourth Committee (Special Political and Decolonization), as it concluded its consideration of decolonization issues.

By the draft, the Assembly would also ask the administering Powers to facilitate political education programmes to increase people's awareness of their options. The 12 Territories covered by the draft are: American Samoa, Anguilla, Bermuda, the British Virgin Islands, the Cayman Islands, Guam, Montserrat, Pitcairn, St. Helena, Tokelau, Turks and Caicos Islands and the United States Virgin Islands.

The text was approved, as a whole, by a vote of 124 in favour to 4 against (Georgia, Israel, United Kingdom, United States), with 6 abstentions (Argentina, Belgium, France, Haiti, Morocco, The former Yugoslav Republic of Macedonia), as amended. (For details see Annex XXXV.)

It also calls for measures to protect and conserve the environment of the Territories and for specialized agencies to continue environmental monitoring. It calls as well on the administering Powers to continue cooperating with territorial governments to counter drug trafficking and money laundering, and to facilitate the dispatch of United Nations visiting missions.

Prior to approval of the draft on the 12 Non-Self-Governing Territories, the Committee took action on 40 amendments submitted by the United Kingdom and the United States, voting on 34 of them. Of those, 15 were approved and 19 defeated. (See annexes I through XXXIV.) Six of the proposals were approved without a vote.

Also this afternoon, the Committee approved texts without a vote on the situations in Western Sahara, New Caledonia and Gibraltar.

By the terms of the draft on Western Sahara, the Assembly would call on the Kingdom of Morocco and the Frente POLISARIO to work with the Secretary- General and the United Nations Mission for the Referendum in Western Sahara (MINURSO) to implement the settlement plan in accordance with the relevant Security Council resolutions. It would express the hope that direct talks between the two parties would soon resume.

The Assembly would also restate its support for further efforts by the Secretary-General and the United Nations, in cooperation with the Organization of African Unity (OAU), to organize and supervise a self-determination referendum, in conformity with the settlement plan approved by the Council.

By the draft decision on Gibraltar, the Assembly would urge the Governments of Spain and the United Kingdom to continue their negotiations with the aim of reaching a definitive solution to the problem of Gibraltar in the light of relevant General Assembly resolutions and in the spirit of the United Nations Charter.

The draft resolution on New Caledonia would have the Assembly invite all parties to continue providing a framework for special progress towards self- determination for the Territory, in accordance with the Matignon Accords.

Statements on Western Sahara were made by the representatives of Morocco, Indonesia, Algeria, United States, Slovenia, France, Senegal, Gabon and the United Republic of Tanzania.

Statements on the Non-Self-Governing Territories text were made by the United Kingdom, Sierra Leone (as Acting Chairman of the Special Committee on decolonization), Papua New Guinea (as Chairman of the Subcommittee on Small Territories, and in his personal capacity), New Zealand, United States, Cuba (as Vice-Chairman of the Special Committee), Russian Federation, Libya, Brazil and Portugal.

The Fourth Committee will meet again at 3 p.m. Monday, 6 November, to begin its consideration of international cooperation in the peaceful use of outer space.

Committee Work Programme

The Fourth Committee (Special Political and Decolonization) met this afternoon to continue taking action on a series of draft resolutions and decisions on decolonization questions.

The Committee was expected to take action on a two-part draft resolution approved by the Special Committee on Decolonization concerning the situation in 12 Non-Self-Governing Territories: American Samoa, Anguilla, Bermuda, British Virgin Islands, Cayman Islands, Guam, Montserrat, Pitcairn, St. Helena, Tokelau, Turks and Caicos Islands and the United States Virgin Islands.

In addition, the Committee was scheduled to take action on draft resolutions on the question of Western Sahara and the situation in New Caledonia, as well as a draft decision submitted by the Chairman on the question of Gibraltar.

A draft resolution on Western Sahara (Document A/C.4/50/L.5 Rev.1) would have the Assembly reiterate its support for further efforts by the Secretary- General to have the United Nations organize and supervise, in cooperation with the Organization of African Unity (OAU), a self-determination referendum for the people of the Territory, in conformity with the settlement plan approved by the Security Council. The Assembly would reaffirm the agreed goal of holding a free, fair, and impartial referendum for the people of the Western Sahara without any military or administrative constraints.

By other terms of the text, the Assembly would note with concern the insufficient progress made towards the fulfilment of the settlement plan, including the identification process, the code of conduct, the release of political prisoners, the confinement of troops of the Frente Popular para a Liberacion de Saguia el-Hamra y de Rio de Oro and the arrangements for the reduction of the Moroccan troops in the territory.

The Assembly would also take note of the Security Council's decision to review arrangements for the implementation of the completion of the identification process and to consider at that time any further necessary measures which might be taken to ensure the prompt completion of the process and all other aspects relevant to the settlement plan.

The Assembly would call on the Kingdom of Morocco and the Frente Polisario to work with the Secretary-General and the United Nations Mission for the Referendum for the People of the Western Sahara (MINURSO) to implement the settlement plan in accordance with the relevant Security Council resolutions.

The Assembly would also express the hope that direct talks between the two parties would soon resume, in order to create a propitious atmosphere conducive to a speedy and effective implementation of the settlement plan. It would request the Special Committee to continue considering the situation in Western Sahara, bearing in mind the ongoing referendum process, and to report at the next session of the General Assembly.

The draft resolution is sponsored by the following 58 States: Algeria, Antigua and Barbuda, Bahamas, Barbados, Belize, Bolivia, Botswana, Burundi, Cape Verde, Costa Rica, Cuba, Cyprus, Dominica, Ecuador, Ethiopia, Fiji, Gambia, Ghana, Grenada, Guyana, Honduras, Jamaica, Kenya, Lesotho, Malawi, Marshall Islands, Mauritania, Mauritius, the Federated States of Micronesia, Mozambique, Namibia, Nicaragua, Niger, Nigeria, Palau, Panama, Papua New Guinea, Paraguay, Rwanda, Saint Kitts and Nevis, Saint Lucia, Saint Vincent and the Grenadines, Samoa, Seychelles, Sierra Leone, Slovenia, Solomon Islands, South Africa, Suriname, Trinidad and Tobago, Uganda, United Republic of Tanzania, Uruguay, Vanuatu, Venezuela, Viet Nam, Zambia and Zimbabwe.

By a draft decision on Gibraltar submitted by the Chairman (Document A/C.4/50/L.3), the Assembly would urge the Governments of Spain and the United Kingdom to continue their negotiations with the aim of reaching definitive solution to the problem of Gibraltar in the light of relevant General Assembly resolutions and in the spirit of the United Nations Charter.

By the terms of a draft resolution on New Caledonia (Document A/50/23, part V), the Assembly would invite all parties to continue providing a framework for special progress towards self-determination for the Territory, in accordance with the Matignon Accords. It would welcome measures to diversify the New Caledonian economy, and greater progress in housing, employment, education, training and health care.

The draft acknowledges the contribution by the Melanesian Cultural Centre in protecting the Territory's indigenous culture. It notes positive initiatives to protect New Caledonia's natural environment, notably the "Zoneco" operation designed to map and evaluate marine resources within the Territory's economic zone. It also welcomes high-level visits by delegations from countries of the Pacific region and from members of the South Pacific Forum.

A general consolidated text on the 12 Non-Self-Governing-Territories (Document A/50/23, Part VI), reaffirms that it is ultimately for the people of those Territories to determine freely their political status and requests the administering Powers to facilitate political education programmes to increase people's awareness of their options.

monitoring. It also calls on the Administering powers to continue cooperating with territorial governments to counter drug trafficking and money laundering, and to facilitate the dispatch of United Nations visiting missions.

The second part of the resolution deals with specific conditions in each Territory.

Regarding American Samoa, the administering Power is called on to continue promoting the country's economic and social development and the development of manpower resources.

The section on Anguilla requests all countries, organizations and United Nations agencies with deep-sea fishing experience to assist the Territory to improve its capacity to exploit deep-sea fishing.

On Bermuda, the administering Power is called on to facilitate a visit by a team from the Special Committee to observe the independence referendum in Bermuda and to continue socio-economic development programmes.

In the section on the British Virgin Islands, the administering Power, specialized agencies and financial institutions are requested to continue providing development assistance, bearing in mind the vulnerability of the Territory to external factors.

Regarding the Cayman Islands, the text asks the administering Power to consult with the territorial Government in facilitating the expansion of current employment programmes and Agencies and United Nations organizations to continue their assistance to strengthen, develop and diversify the economy. It also asks the administering Power and the territorial Government to continue cooperating to counter money laundering, smuggling of funds and other related crimes, as well as drug trafficking.

On Guam, the Assembly would call on the administering Power and the territorial Government to expedite the early conclusion of negotiations on the draft Guam Commonwealth Act and the future status of the Territory. It would also request the administering Power to continue assisting the elected government in achieving its political, social and economic goals.

It would also ask the administering Power and territorial Government to continue cooperating in the transfer of land to the people of the Territory, and take the necessary steps to safeguard their property rights. The administering would also be asked to continue recognizing and respecting the political rights and cultural and ethnic identity of the Chamorro people.

In the section on Montserrat, the administering Power is asked to conduct an appropriate exercise, at the earliest possible date, to ascertain the will of the people on the Territory's future status. Specialized agencies

and other United Nations organizations, as well as regional and multilateral financial institutions, are asked to continue assistance to strengthen, develop and diversify Montserrat's economy.

The text expresses satisfaction with the continued economic and social advancement of the Territory of Pitcarin, as well as the improvement of its communications with the outside world and its conservation management plan. The administering Power is asked to continue its assistance for social and economic improvement.

On St. Helena, the administering Power would be asked to conduct a constitutional review in the Territory, taking into account the wishes of its population. Relevant regional and international organizations would be asked to continue supporting the territorial Government to address the socio- economic development of the Territory.

The Assembly would welcome New Zealand's assurances that it would meet its obligation to the United Nations with respect to Tokelau and abide by the freely expressed wishes of the people with regard to their future status. It would invite the administering Power and United Nations agencies to continue their assistance to the social and economic development of Tokelau.

On the Turks and Caicos Islands, the Assembly would ask the administering Power to conduct, at the earliest possible date, an appropriate exercise to ascertain the will of the people regarding the Territory's future status. It would call on the administering Power and relevant regional and international organizations to continue to support the efforts of the territorial Government to address socio-economic development.

Finally, with respect to the United States Virgin Islands, the Assembly would request the administering Power to continue to assist the elected territorial Government in achieving its political, economic and social goals, and to facilitate the participation of the Territory, as appropriate, in various organizations, particularly the Organization of Eastern Caribbean States and the Caribbean Community. It would welcome the negotiations between the administering Power and the territorial Government on the question of Water Island.

The United States and the United Kingdom have submitted amendments to the text (Document A/C.4/50/L.6).

The Question of Western Sahara

AHMED SNOUSSI (Morocco) asked the Chairman to use his wisdom to prevent the Committee's work on the question of Western Sahara from getting bogged down in controversy. The issue was important to his country and to the international community, which had asked the United Nations to hold the

referendum. His Government had accepted the settlement plan and had given its cooperation to the process by making concessions.

Every year, the Committee debated the issue and approved a draft consensus without a vote, he continued. However, as had occurred last year, a delegation had tried to put forward a draft that appeared to be supportive, but which distorted the work of the Committee. He said his Government had not been consulted in the preparation of the draft text. He proposed that the Chairman ensure that amendments that had not been submitted formally could be incorporated, to restore the balance of the draft.

THOMAS SAMODRA SRIWIDJAJA (Indonesia) seconded the request by Morocco for the Chairman to apply his good offices to ensure a consensus on the draft.

RAMTANE LAMAMRA (Algeria) said that he was surprised by Morocco's statements. He had too much respect for that delegate not to believe that what he had said was due to a lack of information. He asked whether the Moroccan delegate had been present during the Committee's discussions on Western Sahara. Even after those discussions, the Moroccan representative had said amendments to the draft were to be submitted by some 60 co-sponsors and had requested that the draft be submitted in all official languages, which had been done. The texts had reached the co-sponsors by informal channels and they had reacted responsibly by submitting amendments. During the debate, the representative of Morocco said he had been in contact with co-sponsors through other channels.

Some alterations to the draft had been made and there was no need for more alterations or amendments, he continued. Now, the Committee was being told that there had been no contacts or efforts made to reach a consensus text. He was surprised to hear statements that the text did not take into account the position of certain parties. The text was balanced and did not aim to satisfy one party. The Committee had shown patience. At this late hour the Chairman should not be put into a difficult position by a personal request. Those who had already made such efforts knew the situation with regard to who was willing to make concessions and who was not.

It was very important that the text be adopted by consensus, he said. He had been authorized by POLISARIO to express its wish that a consensus be achieved. The international community must get behind the text. His country bordered on the Western Sahara and knew that if MINURSO withdrew, then the conflict could erupt at its border. The process was at a critical stage and that was the real issue, not texts and wordings. The Committee was not involved in a stylized exercise, but a proposal to bring peace and harmony to a region.

EDWARD GNEHM (United States) said that his Government believed deeply in a procedure that should boost the peace process and not drive the parties into

a conflict that everyone had been trying to avoid for a number of years. His Government had tried to build a consensus around the draft resolution and had failed. Although one party indicated it wanted a consensus, it had, in fact, not been willing to make "very modest adjustments" to the text. Although the hour was late, there was a need for consensus on a text that would bolster the peace process. The parties should come together without sacrificing the principles they considered so important.

He said he agreed with the statement by Algeria that the peace process must be saved and that it was at a critical stage. If that delegate felt that way, then he could not object to the Chairman using his good offices to reach a consensus.

DANILO TURK (Slovenia) said the draft resolution was extremely important and was coming at an important moment. His Government had become a co-sponsor in the hope that there would be a consensus on the text and he hoped that it would be achieved.

Mr. DELAUNAY (France) requested that the meeting be suspended for five minutes so that a consensus, which he believed was very close, could be achieved.

KEBA BIRANE CISSE (Senegal) said he agreed with France that broader consultations on the draft were needed. He preferred that a consensus was achieved.

DIEUDONNE NDIAYE (Gabon) said he agreed with the request for suspension.

The Chairman suspended the meeting for five minutes.

Action on Draft Resolutions

The Committee then turned to the draft decision on Gibraltar, approving it without a vote.

It also approved the draft resolution on New Caledonia without a vote.

The Committee then turned to its draft resolutions A and B on the 12 Non-Self-Governing-Territories and the amendments submitted by the United Kingdom and the United States.

PAUL THOMAS ARKWRIGHT (United Kingdom) introduced the proposed amendments. He welcomed the acknowledgement by the Chairman of the Special Committee that times have changed, and that the cold war should be a thing of the past. It was in that spirit that the amendments had been proposed. Despite consultations with the Special Committee Chairman, it had been

impossible to reach agreement on the amendments, which was a result of misunderstanding the good intentions behind the proposals.

He then reviewed the rationale behind a number of the proposed amendments.

The proposed amendments to draft resolution A are as follows:

1. This would amend the first preambular paragraph. Amendment 1(a) would insert "the Non-Self-Governing Territories of" after "questions of". Amendment 1(b) would insert "hereinafter 'the Territories'" after "United States Virgin Islands".

2. This would amend the fourth preambular paragraph, by deleting "all resolutions and decisions of the United Nations relating to those Territories, including".

3. This would amend the fifth preambular paragraph, by deleting "remaining Non-Self-Governing".

4. This would amend the seventh preambular paragraph. It would replace "those Territories" with "the Territories".

5. This would amend the ninth preambular paragraph, by deleting "Non-Self-Governing".

6. This would amend the twelfth preambular paragraph. It would replace "Non-Self-Governing" with "the".

7. This would replace the thirteenth preambular paragraph with the following:

"Recognizing that the wishes of the peoples in the Territories with regard to their political status can be ascertained by referendums and other forms of popular consultation, including free and fair elections conducted by the Governments of the Territories,".

8. This would amend the fourteenth preambular paragraph. Amendment 8(a) would replace "an effective means" with "one effective means". Amendment 8(b) would delete "Non-Self-Governing". Amendment 8(c) would replace "those Territories" with "the Territories".

9. This would amend operative paragraph 1. Amendment 9(a) would replace "Approves" with "Notes". Amendment 9(b) would insert "the Non-Self-Governing Territories of" after "relating to". Amendment 9(c) would add "hereinafter 'the Territories'" after "United States Virgin Islands".

10. This would amend operative paragraph 2. Amendment 10(a) would replace "those Territories" with "the Territories". Amendment 10(b) would delete "including independence,".

11. This would amend operative paragraph 3. Amendment 11(a) would replace "those Territories" with "the Territories". Amendment 11(b) would replace "in conformity with the legitimate political status options clearly defined in resolution 1541 (XV)" with "in conformity with legitimate political status options, including those defined in resolution 1541 (XV);".

12. This would replace operative paragraph 4 with one of the following:

"4. Requests the administering Powers to report to the Secretary-General on the wishes and aspirations of the people of the Territories regarding their political status as expressed in referendums and other forms of popular consultation, including free and fair elections conducted by the Governments of the Territories;

"4 bis. Requests the administering Powers to report to the Secretary-General the results of any informed and democratic processes conducted by the Governments of the Territories which indicate the clear and freely expressed wish of the people to change the existing status of the Territory;".

13. This would replace operative paragraph 5 with the following:

"5. Reaffirms that United Nations visiting missions to the Territories at an appropriate time and in consultation with the administering Power are one effective means of ascertaining the situation in the Territories, and requests the administering Powers to keep the possibility of such missions under review;".

14. This would amend operative paragraph 6. It would replace "those Territories" with "the Territories".

15. This would amend operative paragraph 7, by inserting "where appropriate" after "Requests".

16. This would delete operative paragraph 9 and renumber operative paragraphs 10 to 12 as operative paragraphs 9 to 11.

17. This would replace the original operative paragraph 12 with the following:

"11. Requests the Special Committee to report to the General Assembly at its fifty-first session on all relevant information received pursuant to the present resolution."

The proposed amendments to draft resolution B are as follows:

American Samoa

This would replace operative paragraph 1 with the following:

"1. Requests the administering Power to respond to any appropriate exercise conducted by the Government of the Territory which indicates the clear wish of the people to change the future status of the Territory;"

Anguilla

This would replace operative paragraph 1 with the following:

"1. Requests the administering Power to respond to any appropriate exercise conducted by the Government of the Territory which indicates the clear wish of the people to change the future status of the Territory;"

Bermuda

1. This would replace the second preambular paragraph with the following:

"Noting the results of the independence referendum held on 16 August 1995,"

2. This would amend the third preambular paragraph, by deleting "the issue of a referendum and".

3. This would delete operative paragraph 1.

4. This would delete operative paragraph 2.

British Virgin Islands

This would replace operative paragraph 1 with the following:

Guam

1. This would amend the fifth preambular paragraph. It would replace "that he hoped to have a bill for the passage of the Commonwealth Act" with "that the Administration hoped to have comments on the Commonwealth Bill".

2. This would amend operative paragraph 3, by deleting "and to take the necessary steps to safeguard their property rights".

3. This would amend operative paragraph 4, by deleting "the political rights and".

Montserrat

This would replace operative paragraph 1 with the following:

"1. Requests the administering Power to respond to any appropriate exercise conducted by the Government of the Territory which indicates the clear wish of the people to change the future status of the Territory;".

Turks and Caicos Islands

This would replace operative paragraph 1 with the following:

"1. Requests the administering Power to respond to any appropriate exercise conducted by the Government of the Territory which indicates the clear wish of the people to change the future status of the Territory;".

United States Virgin Islands

1. This would replace the third preambular paragraph with the following:

"Noting that a majority of those who voted in the referendum on the political status of the Territory on 11 October 1993 supported the

existing territorial status arrangement with the United States of America,".

2. This would amend the sixth preambular paragraph, by deleting "through bilateral negotiations".

3. This would amend operative paragraph 2, deleting "in particular the Organization of Eastern Caribbean States and the Caribbean Community".

[Note: At the Committee's morning meeting, Alimamy Pallo Bangura (Sierra Leone), speaking as Acting Chairman of the Special Committee on decolonization, said the Special Committee was willing to accept amendments to the texts on Bermuda, Guam and the United States Virgin Islands.]

ALIMAMY PALLO BANGURA (Sierra Leone), speaking as Acting Chairman of the Special Committee on decolonization, reaffirmed the Committee's commitment to carrying out its mandate. It sought to ensure the inalienable right of all peoples to self-determination and independence. When the Special Committee met in July, it implored the administering Powers to sit with it to address the issues raised by the proposed amendments, but they did not do so.

Only at the eleventh hour were amendments being presented, he said. Had they been presented in July, there might have been a meeting of minds. It was in that context that the Special Committee was unable to accept the proposals. It was hoped that the administering Powers would be willing to confer with the Committee on the issues in question in preparation of next year's resolution.

UTULA U. SAMANA (Papua New Guinea), speaking as Chairman of the Subcommittee on Small Territories and in his personal capacity, said the majority of the amendments, if adopted, could seriously undermine and prematurely end the work of the Special Committee. His Government was prepared to participate in streamlining the operation of the Special Committee, but not at the cost of undermining the principles and goals mandated by the Charter and United Nations resolutions. There must be proper consultation on proposed amendments, in order to reach consensus.

The proposed amendments might have been made with good intentions, he said. However, as they stood, most of them ran counter to the Assembly's resolution on the International Decade of the Eradication of Colonialism -- which declared the current decade as the one in which colonialism would be eradicated. His country strongly requested that the administering Authority work together with the Special Committee, whose work had become more innovative and responsive to the new international climate.

He then reviewed a number of the proposed amendments, which he felt could be detrimental to the work of the Special Committee.

COLIN KEATING (New Zealand) speaking as one of the administering Powers, said there was no amendment in respective of the section of the draft resolution regarding Tokelau. One reason for that was the productive work carried out between his delegation and the Special Committee during its session earlier in the year. It was a matter of deep regret that such consultations had not been carried out on the matters now in question.

He said his country could support some of the amendments. However, others were inconsistent with United Nations practice and previous resolutions and New Zealand would not support them. With goodwill, it should have been possible to find common ground, and it was hoped that next year it would be possible to do better.

DAVID BIRENBAUM (United States) said the purpose of the amendments was to bring about a more realistic appraisal of the situation in the Territories, excluding Tokelau. The people in those 11 Territories had achieved a measure of self-government. The current amendments set the stage for recognizing those facts. They did not alter the commitment to the principle of self- determination. Adoption of the amendments would mark an important step towards the common goal of fully implementing the Declaration on decolonization. It would also break the impasse regarding the provision of information by the United States to the Secretary-General.

The spokesman for the Special Committee had acknowledged that, had there been consultations, agreement could have been reached. If indeed there was no substantive disagreement, approval of amendments should not be deferred for purely procedural reasons. He questioned whether there could be any real disagreement with the substance of a number of the proposals. Adoption of the amendments would make it possible for the United States and other Powers to provide information to the Secretary-General, which would enable the self- determination process to move forward.

PEDRO NUNEZ MOSQUERA (Cuba), speaking as Vice-Chairman of the Special Committee on decolonization, associated himself with the representatives of Sierra Leone and Papua New Guinea. It was true that the times had changed, but it seemed that the times had changed only for some. Why were there still administering Powers that refused to cooperate with the Special Committee, as they were obliged to do? Why were there administering Powers that refused to allow United Nations visiting missions to visit those Territories?

"We cannot conceal what's behind this amendment", he said. Mention had been made of free and fair elections, but could a Territory that hosted massive military bases hold free and fair elections? To say that information required under the Charter would be provided only if the amendments were approved was an abuse of the Charter. His delegation would oppose the amendments.

OLEG CHTCHERBAK (Russian Federation) said that, although progress had been made since last year in improving the current text, there was still room for improvement. He did not agree that the amendments had been presented too late. It was never too late to make such improvements. Many of the proposals submitted today were constructive and might be incorporated in the draft resolution.

The representative of Libya, speaking in explanation of vote, said his country had expressed its unhappiness last year about the administering Powers of those Territories which did not enjoy self-determination. That behaviour was being repeated this year by the administering Powers. "Are we going to betray our mission?" Libya opposed the amendments.

The Fourth Committee then took action on the proposed amendments to draft resolution A.

The representative of Brazil, speaking in explanation of vote, supported the amendments which improved the quality of the language of the draft resolution or updated it in the light of recent developments in decolonization. It did not support those which were not in conformity with the Declaration on decolonization. He urged the administering Power, in future, to submit its proposals in a timely fashion.

Fourth Committee - 17 - Press Release GA/SPD/71 15th Meeting (PM) 3 November 1995

The representative of Portugal said some of the amendments were a matter of concern. In view of its mandate, he did not see how the role of the Special Committee could be limited or suppressed altogether. Portugal did not accept that popular forms of self-determination could be left in the hands of local authorities.

The Committee then turned to the combined draft resolution as a whole, as amended.

The combined draft resolution was then approved as a whole, as amended, by a vote of 124 in favour to 4 against (Georgia, Israel, United Kingdom, United States), with 6 abstentions (Argentina, Belgium, France, Haiti, Morocco, The former Yugoslav Republic of Macedonia) (Annex XXXV).

The representative of the United Kingdom said he voted against the draft resolution because the amendments submitted by his country and the United States had not been accepted. It was a matter for the elected governments or administrations of the Territories in question to decide whether and at what time to consult their electorates on a change on their constitutional arrangements with the United Kingdom. He added that the Governor of St. Helena had informed the Territory's legislative body that he would be ready to enter into a debate on constitutional review.

Western Sahara

DAUDI N. MWAKAWAGO (United Republic of Tanzania) read out a proposed amendment to preambular paragraph 11 of the draft text on the question of Western Sahara, which would read as follows: "expressing the hope for a rapid resolution of the problems causing delays in the completion of the identification process, as well as the code of conduct, the release of political prisoners, the confinement of troops of the Frente POLISARIO, and the arrangements for the reduction of Moroccan troops in the Territory."

He said it was similar to the original preambular paragraph and reinforced the whole resolution.

He then introduced the draft resolution on the question of Western Sahara. He said that because of support given by the Committee, there was a settlement plan which had been accepted by Morocco and POLISARIO. However, problems which stood in the way of the plan's early implementation were of serious concern and pointed to the need for concerted action to ensure the success of the peace process. The draft's co-sponsors had adopted a constructive approach, and the goal was to reaffirm full support of the implementation of the settlement plan based on the relevant Security Council resolutions leading to a free, fair and impartial referendum in the Territory. The considerable number of co-sponsors illustrated the merit of such an

approach and the international community's desire to arrive at a just and lasting solution to the dispute.

He said the text was largely inspired by General Assembly resolution 49/50, which had been adopted by consensus last year, and by the recent Security Council resolutions on the issue. The text called on the Kingdom of Morocco and the POLISARIO to work with the Secretary-General and MINURSO in a spirit of genuine cooperation to implement the settlement plan in accordance with relevant Council resolutions. The draft was aimed at bringing the full support of the General Assembly to the peace process in Western Sahara and was also intended to give impetus to that process. Therefore, the draft could only be adopted by consensus so as to expedite the goal of restoring the peace process.

Mr. SNOUSSI (Morocco) said the new paragraph was of great importance and not a mere caprice. He wanted it made clear that the earlier paragraph had been an obstacle for his delegation. The other amendments were well intended and justified.

The Committee then approved the revised draft resolution on Western Sahara, as orally amended, without a vote.

Mr. SNOUSSI (Morocco) said several delegations had been harassed to co- sponsor a resolution which every year took up a lot of the Committee's time and brought nothing to the people of Western Sahara. The great innovation had been the addition proposed by Morocco, which had been accepted and that others had tried to sabotage. A more serious approach would have been to give full support to the Secretary-General's efforts and the whole peace process.

He said that it should be known that the people of Western Sahara had not been able to express their will and would only be able to do that when they crossed the border and voted freely. For 23 months his Government had expressed compromise while others had obstructed and blocked the peace process. Morocco had given every chance for dialogue to the other side, which had not accepted it.

He said excessive appeals had been allowed to dominate the Committee and he hoped there would be no more acrimony. Despite attempts to misguide the Committee, "and I use the word lies" he said, his country would give its full support to the Secretary-General. He deplored the spirit of confrontation which had prevailed. Morocco had been the one to accept the draft resolution.

Mr. LAMAMRA (Algeria) thanked the Chairman for his efforts and said his Government would not rest until decolonization had been achieved. On a legal point, he said there had been no follow up on the request for a legal opinion on the denial of petitioner Frank Ruddy to speak before the Committee. The views of the Secretariat should not be a precedent and his Government would

support Mr. Ruddy if he wished to appear before the Committee again next year. As the United Nations legal counsel had not yet given an opinion on the matter, his Government reserved its right to ask the International Court of Justice for its opinion.
