Security Council 1267/1989 Committee Revises Its Guidelines

 


On 15 April 2013, the Security Council Committee pursuant to resolutions 1267 (1999) and 1989 (2011) concerning Al-Qaida and associated individuals and entities adopted revised Guidelines for the Conduct of its Work.  The Guidelines were revised in compliance with paragraph 46 of Security Council resolution 2083 (2012), which directed the Committee to review its Guidelines.


A number of sections have been amended, including the sections on Listing (Section 6), Delisting (Section 7), Exemptions from the Assets Freeze (Section 11) and Exemptions from the Travel Ban (Section 12).  The Guidelines reflect the new provisions in resolution 2083 (2012) reversing the assumption that States proposing an individual or entity for listing wish to have their identities as designating States kept confidential and authorizes the Focal Point mechanism established in resolution 1730 (2006) to receive exemption requests to the assets freeze and travel ban, submitted by or on behalf of individuals and entities on the Al-Qaida Sanctions List.   Furthermore, the Guidelines reflect the provision in resolution 2083 (2012) strongly urging Member States to provide all relevant information to the Ombudsperson, including confidential information where appropriate, in a timely manner.  In addition, a number of technical amendments have been included with a view to enhancing accuracy and consistency throughout the text and clarifying Committee practice.


The Committee has adopted the revised Guidelines to facilitate the conduct of its own work and provide useful guidance to Member States in their efforts to implement the relevant Security Council resolutions, including resolution 2083 (2012).  The English language version of the revised Guidelines is available on the Committee’s website* and versions of the Guidelines in all six official languages will be made available on the website shortly.
