Security Council Sets 27 April as Date for Election

 

to Fill Vacancy on International Court of Justice

 

The Security Council this morning decided that an election to fill the vacancy on the International Court of Justice, created by the recent resignation of Judge Awn Shawkat Al-Khasawneh, will take place on 27 April 2012.

Resolution 2034 (2012), adopted unanimously, notes with regret that the resignation of Judge Al-Khasawneh took effect on 31 December 2011.

According to the Court’s Statute, relevant articles of which were distributed to the Council through a note by the Secretary-General (document S/2012/38), International Court of Justice judges must be chosen by coordinated actions of both the Council and the General Assembly, with the date of elections determined by the Council.

The note also states that Judge Al-Khasawneh’s term of office will end on 5 February 2018.  The Judge was elected a member of the Court from February 2000 and was re-elected in November 2008.

The meeting started at 10:13 a.m. and ended at 10:15 a.m.

The full text of resolution 2034 (2012) reads as follows:

 “The Security Council,

“Noting with regret the resignation of Judge Awn Shawkat Al-Khasawneh, taking effect on 31 December 2011,

“Noting further that a vacancy in the International Court of Justice for the remainder of the term of office of Judge Awn Shawkat Al-Khasawneh thus occurred and must be filled in accordance with the terms of the Statute of the Court,

“Noting that, in accordance with article 14 of the Statute, the date of the election to fill the vacancy shall be fixed by the Security Council,

“Decides that the election to fill the vacancy shall take place on 27 April 2012 at a meeting of the Security Council and at a meeting of the General Assembly at its sixty-sixth session.”
