The General Assembly, faithful to the recommendations of its First Committee (Disarmament and International Security), where delegations in a high-stakes debate championed common positions but fell short of bridging age-old divides over how best to neutralize the nuclear-weapon threat, cast a wider net of nuclear-weapon-free zones, and open a passage to negotiations in the Conference on Disarmament, today adopted 58 texts, requiring 39 separate recorded votes in all.


Along with its many resolutions on nuclear disarmament, and following closely the Committee’s voting pattern, the Assembly adopted a multitude of texts on a broad range of other critical themes, among them, strengthening the chemical and biological weapons treaties and preventing terrorists’ acquisition of those weapons as well as an arms race in outer space, enhancing control of missiles, forging ahead with the arms trade treaty, and augmenting regional security. 


A draft on united action towards the total elimination of nuclear weapons drew much attention, as the Assembly, expressing deep concern at the catastrophic humanitarian consequences of any use of nuclear weapons, called on nuclear-armed States to reduce and ultimately eliminate all types of those weapons, deployed and non-deployed, and emphasized the importance of the principles of irreversibility, verifiability and transparency.


In that connection, the Assembly issued a call on those States to promptly engage on diminishing the role and significance of nuclear weapons in all military and security concepts, doctrines and policies.  It adopted the resolution by a recorded vote of 174 in favour to 1 against (Democratic People’s Republic of Korea) with 13 abstentions.  (Please see Annex XXVII for details of the vote.)


Prior to passage of the text as a whole, recorded votes were taken on several contentious provisions, including a clause — operative paragraph 2 —concerning accession to the Nuclear Non-Proliferation Treaty (NPT), which it retained by 180 in favour to 3 against (Democratic People’s Republic of Korea, India, Israel), with 3 abstentions (Bhutan, Mauritius, Pakistan).  (Annex XXIII)


Operative paragraph 8 concerning ratification of the Comprehensive Nuclear-Test-Ban Treaty (CTBT) and maintenance of test bans on nuclear-weapon test explosions held by a recorded vote of 182 in favour to 1 against (Democratic People’s Republic of Korea), with 4 abstentions (India, Iran, Mauritius, Syria) (Annex XXIV).  A clause calling for the immediate start of negotiations on a fissile material ban, operative paragraph 9, was retained by a recorded vote of 177 in favour to 2 against (China, Pakistan) with 8 abstentions (Democratic People’s Republic of Korea, Ecuador, India, Iran, Israel, Mauritius, Russian Federation, Syria).  (Annex XXV)


A further provision on universalization of the comprehensive safeguards agreements of the International Atomic Energy Agency (IAEA), operative paragraph 16, was also adopted, by a recorded vote of 178 in favour to 1 against (Democratic People’s Republic of Korea), with 7 abstentions (Argentina, Brazil, India, Iran, Israel, Mauritius, Pakistan).  (Annex XXVI)


Calling on Israel to accede to the NPT without further delay — in another traditionally contested resolution — and on it not to develop, produce, test or otherwise acquire nuclear weapons, to renounce possession of those weapons, and place all its unsafeguarded nuclear facilities under full-scope Agency safeguards, the Assembly welcomed the conclusions on the Middle East of the 2010 NPT Review Conference, according a resolution on risk of nuclear proliferation in the Middle East, by a recorded vote of 174 in favour to 6 against (Canada, Federated States of Micronesia, Israel, Marshall Islands, Palau, United States) with 6 abstentions (Australia, Cameroon, Côte d’Ivoire, Ethiopia, India, Panama).  (Annex XXXVII)


The fifth preambular paragraph, concerning the decision of the 1995 NPT Review and Extension Conference related to adherence to the NPT and IAEA safeguards was retained by a recorded vote of 180 in favour to 2 against (India, Israel), with 2 abstentions (Bhutan, Pakistan).  (Annex XXXV)


Preambular paragraph 6, concerning calling on States not party to the NPT to accede to it and to accept International Atomic Energy Agency (IAEA) safeguards was retained by a recorded vote of 180 in favour to 2 against (India, Israel), with 2 abstentions (Bhutan, Pakistan).  (Annex XXXVI)


The following texts also took recorded votes in the nuclear cluster:  Treaty on a Nuclear-Weapon-Free Zone in Central Asia (Annex III); follow-up to the advisory opinion of the International Court of Justice on the legality of the threat or use of nuclear weapons (Annex V); Towards a nuclear-weapon-free world:  accelerating the implementation of nuclear disarmament commitments (Annex VII); General Assembly High-Level Meeting on Nuclear Disarmament (Annex XI); The Hague Code of Conduct against Ballistic Missile Proliferation (Annex XII); convention on the prohibition of the use of nuclear weapons (Annex XXXIV); Reducing nuclear danger (Annex XVI); Decreasing the operational readiness of nuclear weapons systems (Annex XVIII); nuclear-weapon-free southern hemisphere and adjacent areas (Annex XXI); taking forward multilateral nuclear disarmament negotiations (Annex XXII); nuclear disarmament (Annex XXIX); conclusion of effective international arrangements to assure non-nuclear States against the use or threat of use of nuclear weapons (Annex I); and CTBT (Annex XXXIX). 


Concerning on other weapons of mass destruction, the Assembly, acting without a vote, called on Member States to support international measures to prevent terrorists from acquiring weapons of mass destruction.  Resolutions on the Biological and Chemical Weapons Convention were also adopted without votes.  However, the resolution to uphold the authority of the 1925 Geneva Protocol, which recalled the long-standing determination of the international community to achieve the effective prohibition of chemical and biological weapons and called upon those States that maintain reservations to the 1925 Geneva Protocol to withdraw them, required adoption by a recorded vote (Annex VIII).  Also requiring a recorded vote was the resolution on preventing an outer space arms race (Annex II).


Related to the fervent hope of many in the disarmament community to implement those and other related texts, the Assembly adopted several concerning the revitalization of the United Nations disarmament machinery.  Among them was one urging the Conference on Disarmament to agree on and implement early in 2013 a balanced and comprehensive programme of work that includes the immediate commencement of negotiations on a treaty banning the production of fissile material.  The resolution was adopted by a recorded vote of 166 in favour to 1 against ( Pakistan), with 21 abstentions.  (Annex XX)


In that connection, the Assembly requested the Secretary-General to establish a Group of Governmental Experts, which, taking into account a report containing the views of Member States, will make recommendations on possible elements which could contribute to such a treaty.


Setting out further the outline of the group’s composition and task, the Assembly determined that it will operate on the basis of consensus, without prejudice to national positions in future negotiations, and will meet in Geneva for two sessions of two weeks in 2014 and in 2015.  A recorded vote was required on the provision establishing the Group, operative paragraph 3, which the Assembly adopted by a recorded vote of 156 in favour to 3 against ( Iran, Pakistan, Syria), with 21 abstentions.  (Annex XIX)


By the terms of a resolution on taking forward multilateral nuclear disarmament negotiations, the Assembly, mindful of the role and functions of the Conference on Disarmament and the Disarmament Commission, decided to establish an open-ended working group to develop proposals to advance those negotiations for the achievement and maintenance of a world without nuclear weapons.  It did so by a recorded vote of 147 in favour to 4 against (France, Russian Federation, United Kingdom, United States), with 31 abstentions.  (Annex XXII)


The Assembly agreed, without a vote on a draft decision, to keep on its agenda the item on the Conference’s work.


Under a draft resolution concerning the fourth special session of the General Assembly devoted to disarmament, the Assembly decided to hold, at a later date, an organizational session of the Open-Ended Working Group on that subject for the purpose of setting a date for its substantive sessions in 2013 and 2014, and to submit a report on its work, including possible substantive recommendations, before the end of the sixty-ninth session.  It was adopted by a recorded vote of 181 in favour to none against, with 4 abstentions ( France, Israel, United Kingdom, United States).  (Annex XXXIII)


Related resolutions adopted without a vote included reports of the Conference on Disarmament and of the Disarmament Commission; regional centres; Regional Centre for Peace and Disarmament in Asia and the Pacific; Regional Centre in Africa; Regional Centre in Latin America and the Caribbean; United Nations disarmament fellowship; and regional confidence-building measures.


Requiring a recorded vote in the conventional weapons cluster was a resolution on the Mine-Ban Treaty (Annex IV) and a decision on transparency in armaments.  (Annex XXXII)


Additional resolutions in that cluster were adopted without a vote, including:  Convention on Certain Conventional Weapons; assistance to States for curbing the illicit traffic in small arms and light weapons and collecting them; information on confidence-building measures; and the illicit trade in small arms and light weapons in all its aspects.


Concerning regional disarmament, the Assembly adopted, by a recorded vote, a resolution on conventional arms control at the regional and subregional levels (Annex XXXI).  Adopted without a vote in that cluster were resolutions on strengthening security and cooperation in the Mediterranean region; maintenance of international security in South-Eastern Europe; regional disarmament; and confidence-building measures in the regional and subregional context.


In the cluster on other disarmament measures and international security, the Assembly adopted 10 resolutions and one decision, with recorded votes taken on three of those texts:  preventing and combating illicit brokering activities (Annex XV); effects of the use of armaments and ammunitions containing depleted uranium (Annex IX); and promoting multilateralism for disarmament.  (Annex X)


The Assembly acted without a vote on the following resolutions:  observance of environmental norms in the drafting and implementation of agreements on disarmament and arms control; relationship between disarmament and development; developments in the field of information and telecommunications in the context of international security; United Nations study on disarmament and non-proliferation education; women, disarmament, non-proliferation and arms control; Consolidation of peace through practical disarmament measures; and the United Nations Disarmament Information Programme.  A decision on the role of science and technology in disarmament was also adopted without a vote.


The Assembly postponed its consideration of a draft resolution concerning the arms trade treaty, pending completion of the programme budget implications report by the Fifth Committee (Administrative and Budgetary).


The General Assembly will meet again at 10 a.m. on Monday, 10 December, to take up Oceans and the Law of the Sea, among other matters.


Background


The General Assembly met to consider the 19 reports of the First Committee (Disarmament and International Security) and to take action on 52 draft resolutions and six draft decisions contained therein.


Action on Texts


Committee Rapporteur KNUT LANGELAND ( Norway) introduced the reports.


The Assembly first took up the report on the reduction of military budgets (document A/67/401), for which no proposal had been put forward.


It next turned to the report on the African Nuclear-Weapon-Free Zone Treaty (document A/67/402), adopting the draft resolution contained therein without a vote.  By so doing, it called on African States that have not yet done so to sign and ratify the Treaty as soon as possible.  It also called upon the States contemplated in Protocol III of the Treaty to take all necessary measures to ensure the speedy application of the Treaty to territories for which they are internationally responsible, as applicable, and on the African States parties to the Nuclear Non-Proliferation Treaty (NPT) that have not yet done so to conclude comprehensive safeguards agreements with the International Atomic Energy Agency (IAEA).


Turning to the report on the maintenance of international security — good neighbourliness, stability and development in South-Eastern Europe (document A/67/403), containing a draft decision by the same name, the Assembly agreed without a vote to include the item in the provisional agenda of its sixty-ninth session.


The Assembly then took up the report on the developments in the field of information and telecommunications in the context of international security (document A/67/404), which contains one draft resolution by the same name.  By its terms, the Assembly would call upon Member States to promote further at multilateral levels the consideration of existing and potential threats in the field of information security, as well as possible strategies to address them, consistent with the need to preserve the free flow of information.


It would invite all Member States to report to the Secretary-General their views on the following:  general appreciation of the issues; efforts taken at the national level to strengthen information security and promote international cooperation in this field; possible measures that could be taken by the international community to strengthen information security at the global level; and the content of relevant international concepts aimed at strengthening the security of global information and telecommunications systems.


The draft resolution was adopted without a vote.


When the Assembly turned to the report on the establishment of a nuclear-weapon-free zone in the region of the Middle East (document A/67/405), it adopted without a vote the resolution contained therein.  By so doing, it urged all parties directly concerned to consider taking practical and urgent steps to implement the proposal and invite them to adhere to the NPT, place all nuclear activities under IAEA safeguards, and not to develop, produce, test or otherwise acquire nuclear weapons or permit the stationing on their territories, or territories under their control, of nuclear weapons or nuclear explosive devices.


Speaking after the vote, the representative of Israel said his delegation had joined consensus, but it had some reservations about certain elements in the text, including language related to application of IAEA safeguards.  The delegation felt issues of regional security should be resolved within the regional context and through a pragmatic, realistic and step-by-step approach.  In the 1990s, there was a mechanism for dialogue, but there was no regional dialogue and thus it was not possible to build confidence and defuse tension.  Regional security was fragile.  Israel’s very survival was being called into question, with some States trying to erase the country from the world map by not recognizing its right to exist.  “Only direct dialogue could move us to regional security,” he said, expressing hope for the democratization of the Arab World.


Taking up the report on conclusion of effective international arrangements to assure non-nuclear States against the use or threat of use of nuclear weapons (document A/67/406), the Assembly adopted the draft resolution contained therein by a recorded vote of 126 in favour to none against, with 57 abstentions.  (Annex I)


By its terms, the Assembly reaffirmed the urgent need to reach an early agreement on such assurances, and appealed to all States, especially the nuclear-weapon States, to work actively towards an early agreement on a common approach and, in particular, on a common formula that could be included in an international instrument of a legally binding character.  It recommended that the Conference on Disarmament actively continue intensive negotiations with a view to achieving that goal.


The Assembly then turned to the report on prevention of an arms race in outer space (document A/67/407), adopting the draft resolution contained therein by a recorded vote of 183 in favour to none against, with 2 abstentions (Israel, United States).  (Annex II)


It thus called on all States, in particular those with major space capabilities, to contribute actively to the objective of the peaceful use of outer space and the prevention of an outer space arms race.  It reiterated the primary role of the Conference on Disarmament in such negotiations and invited it to establish a working group on the matter, as early as during its 2013 session.


The Assembly then adopted without a vote the draftdecision contained in the report on the role of science and technology in the context of international security and disarmament (document A/67/408), by which it decided to include an item by the same name in the provisional agenda of its sixty-eighth session.


Next, the Assembly turned to the 36 draft texts contained in the report on general and complete disarmament (document A/67/409).


It adopted draft resolution I on the Treaty on a Nuclear-Weapon-Free Zone in Central Asia by a recorded vote of 146 in favour to 2 against (France, United States), with 35 abstentions (Annex III).  The draft resolution would welcome the Treaty’s entry into force in 2009 and the three consultative meetings of State parties, most recently in June 2012, which identified joint activities by the Central Asian States to ensure fulfilment of the Treaty’s obligations.


The Assembly then adopted draft resolution II on implementation of the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-personnel Mines and on their Destruction, adopting it by a recorded vote of 165 in favour to none against, with 19 abstentions.  (Annex IV)


By that text, the Assembly noted with regret that anti-personnel mines continue to be used in some conflicts around the world, causing human suffering and impeding post-conflict development, and urged all States to remain seized of the issue at the highest political level and, where possible, promote adherence to the Convention through bilateral, subregional, regional and multilateral contracts, outreach, seminars and other means.


The Assembly adopted draft resolution III on follow-up to the advisory opinion of the International Court of Justice on the legality of the threat or use of nuclear weapons by a recorded vote of 135 in favour to 22 against, with 26 abstentions (Annex V).  Sharing the deep concern at the catastrophic humanitarian consequences of any use of nuclear weapons, the Assembly underlined the unanimous conclusion of the Court that there exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control, and called on all States immediately to fulfil that obligation by commending negotiations.


Next, the Assembly turned to draft resolution IV on the arms trade treaty, by which it would decide to convene in New York from 18 to 28 March 2013 a final United Nations Conference on the Arms Trade Treaty, to be governed by the rules of procedure adopted on 3 July 2012, in order to finalize the treaty.  It would also decide that the draft text of the treaty submitted by the President of the Conference on 26 July 2012 would be the basis for future work, without prejudice to the right of delegations to put forward additional proposals on that text.


The Secretariat announced that action on that text would be postponed, pending consideration of its programme budget implications by the Fifth Committee (Administrative and Budgetary).


The Assembly then took up draft resolution V entitled Towards a nuclear-weapon-free world:  accelerating the implementation of nuclear disarmament commitments, which would express deep disappointment at the absence of progress towards multilateral negotiations on nuclear disarmament, in particular, in the Conference on Disarmament.  It would recall the commitment by the nuclear-weapon States to undertake further efforts to reduce and ultimately eliminate all types of nuclear weapons, deployed and non-deployed, and it would encourage further steps by them to ensure the irreversible removal of all fissile material which they designated was no longer required for military purposes.


By further terms of that wide-ranging text, the Assembly would reiterate that each article of the NPT was binding on the States parties at all times and in all circumstances, and it would call upon all States parties to work towards the full implementation of the resolution on the Middle East adopted at the 1995 Review and Extension Conference, including the convening of a Conference in 2012 to be attended by all States of the region on the establishment of a zone in the region free of nuclear and all other weapons of mass destruction.  By a further provision, the Assembly would urge the Democratic People’s Republic of Korea to fulfil its commitments under the six-party talks to abandon all nuclear weapons and existing nuclear programmes and to return, at an early date, to the NPT and to its adherence to its IAEA safeguards agreement.


The Assembly first adopted operative paragraph 11, which would emphasize the fundamental role of the NPT and call on all States parties to spare no effort to achieve its universality, and in that regard, urge India, Israel and Pakistan to accede to it as non-nuclear-weapon States and place all their nuclear facilities under IAEA safeguards, by a recorded vote of 172 in favour to 4 against (India, Israel, Pakistan, United States), with 5 abstentions (Bhutan, Democratic People’s Republic of Korea, France, Russian Federation, United Kingdom).  (Annex VI)


The draft resolution as a whole was adopted by a recorded vote of 175 in favour to 6 against (France, India, Israel, Russian Federation, United Kingdom United States), with 5 abstentions (Bhutan, China, Nicaragua, Pakistan, Palau).  (Annex VII)


The Assembly then adopted draft resolution VI on measures to uphold the authority of the 1925 Geneva Protocol, which would recall the long-standing determination of the international community to achieve the effective prohibition of chemical and biological weapons, and call upon those States that maintain reservations to the 1925 Geneva Protocol to withdraw them, by a recorded vote of 181 in favour to none against, with 4 abstentions (Israel, Marshall Islands, Palau, United States).  (Annex VIII)


The Assembly next adopted draft resolution VII on effects of the use of armaments and ammunitions containing depleted uranium by a recorded vote of 155 in favour to 4 against (France, Israel, United Kingdom, United States), with 27 abstentions (Annex IX).  By so doing, it invited Member States that have used armaments and ammunitions containing depleted uranium in armed conflicts to provide the relevant authorities of affected States, upon request, with information, as detailed as possible, about the location of the areas of use and the amounts used, with the objective of facilitating the assessment of such areas.


Then, acting without a vote, the Assembly adopted draft resolution VIII on observance of environmental norms in the drafting and implementation of agreements on disarmament and arms control, by which it emphasized the importance of that process in the preparation and implementation of disarmament and arms limitation agreements, and called on States to adopt measures towards ensuring the application of scientific and technological progress within the framework of international security, disarmament and other related spheres, without detriment to the environment or to their effective contribution to attaining sustainable development.


The Assembly then turned to draft resolution IX on promotion of multilateralism in the area of disarmament and non-proliferation, by which it would urge the participation of all interested States in multilateral negotiations on the process of arms regulation, non-proliferation and disarmament in a non-discriminatory and transparent manner.  It would underline the importance of preserving the existing agreements and call on Member States to fulfil their individual and collective commitments to multilateral cooperation.  The Assembly adopted the draft resolution by a recorded vote of 132 in favour to 5 against (Federated States of Micronesia, Israel, Palau, United Kingdom, United States), with 50 abstentions.  (Annex X)


The Assembly also adopted draft resolution X on a General Assembly high-level meeting on nuclear disarmament by a recorded vote of 179 in favour to none against, with 4 abstentions (France, Israel, United Kingdom, United States) (Annex XI), by which it decided to convene such a one-day plenary meeting on 26 September 2013, to contribute to achieving the nuclear disarmament goal, and to encourage Member States to participate at the highest level.


Next, the Assembly adopted without a vote draft resolution XI on the relationship between disarmament and development without a vote.  According to this text, the Assembly stressed the importance of that symbiotic relationship and the important role of security in that connection.  Concerned at increasing global military expenditure, which could otherwise be spent on development needs, it urged the international community to devote part of the resources made available by the implementation of disarmament and arms limitation agreements to economic and social development.


The Assembly also adopted without a vote draft resolution XII on assistance to States for curbing the illicit traffic in small arms and light weapons and collecting them, by which it expressed deep concern by the magnitude of human casualty and suffering, especially among children, caused by the illicit proliferation and use of such weapons, and also by the negative impact on the States in the Sahelo-Saharan subregion.  It encouraged the countries of that subregion to facilitate the effective functioning of national commissions to combat the illicit proliferation and it invited the international community to lend its support wherever possible and to provide technical and financial support to strengthen the capacity of civil society organizations to help combat that illicit trade.


The Assembly then adopted draft resolution XIII on The Hague Code of Conduct against Ballistic Missile Proliferation by a recorded vote of 162 in favour to 1 against ( Iran), with 20 abstentions (Annex XII).  By the terms of the draft resolution, the Assembly welcomed progress in implementation, and encouraged the exploration of further ways and means to deal effectively with the proliferation of ballistic missiles capable of delivering weapons of mass destruction.  It invited all States that had not yet subscribed to The Hague Code of Conduct to do so, and encouraged States that had already subscribed to make efforts to increase participation in it and to improve its implementation.


The Assembly next took up draft resolution XIV on preventing and combating illicit brokering activities, by which it would express concern that, if proper measures were not taken, the illicit brokering would adversely affect the maintenance of international peace and security, prolong conflicts, and could impede sustainable economic and social development and result in illicit transfers of conventional arms and the acquisition of weapons of mass destruction by non-State actors.  The Assembly would encourage Member States to fully implement relevant international instruments and resolutions and to establish appropriate national laws and/or measures to prevent and combat the illicit brokering.


It first considered preambular paragraph 12, which would encourage cooperation to prevent and combat illicit trafficking in nuclear materials, and recognize in that regard existing efforts at all levels, including those elaborated at the 2012 Seoul Nuclear Security Summit, consistent with international law.  It adopted that provision by a recorded vote of 183 in favour to 1 against (Democratic People’s Republic of Korea), with 2 abstentions ( Iran, Syria).  (Annex XIII)


Preambular paragraph 13 was adopted by a recorded vote of 181 in favour to 1 against (Democratic People’s Republic of Korea), with 2 abstentions ( Iran, Syria).  (Annex XIV).


The Assembly then adopted the draft resolution as a whole by a recorded vote of 183 in favour to 1 against (Democratic People’s Republic of Korea), with 1 abstention ( Iran).  (Annex XV)


Acting without a vote, the Assembly next adopted draft resolution XV on measures to prevent terrorists from acquiring weapons of mass destruction, by which it called on Member States to support international efforts in that regard, and urged them to take national measures for that purpose.  It asked the Secretary-General to compile a report on measures already taken by international organizations on the linkage between the fight against terrorism and weapons of mass destruction proliferation.


The Assembly then took up draft resolution XVI entitled Reducing nuclear danger, by which it would call for a review of nuclear doctrines and, in this context, immediate and urgent steps to reduce the risks of unintentional and accidental use of nuclear weapons, including through de-alerting and de-targeting nuclear weapons.  It would request the five nuclear-weapon States to take measures to implement those steps, and call upon Member States to take the necessary measures to prevent the proliferation of nuclear weapons in all its aspects and to promote nuclear disarmament, with the objective of eliminating nuclear weapons.  The Assembly adopted the text by a recorded vote of 123 in favour to 48 against, with 15 abstentions.  (Annex XVI)


It turned next to draft resolution XVII on Decreasing the operational readiness of nuclear weapons systems, according to which it would express concern that, notwithstanding the end of the cold war, several thousand nuclear weapons remain on high alert, ready to be launched within minutes, and would call for further practical steps to decrease the operational readiness of nuclear weapons systems, with a view to ensuring that all such weapons are removed from high-alert status.  It would urge States to update the Assembly on progress in that regard.


First, a recorded vote was requested for preambular paragraph 8, by which the Assembly would welcome the adoption by consensus of the conclusions and recommendations for follow-on actions by the 2010 NPT Review Conference.  It retained that provision by a recorded vote of 162 in favour to 4 against (Democratic People’s Republic of Korea, Russian Federation, United Kingdom, United States), with 17 abstentions.  (Annex XVII)


The Assembly then adopted the draft resolution as a whole by a recorded vote of 164 in favour to 4 against (France, Russian Federation, United Kingdom, United States), with 19 abstentions.  (Annex XVIII)


Acting without a vote, the Assembly adopted the following texts:  draft resolution XVIII entitled United Nations study on disarmament and non-proliferation education; draft resolution XIX on women, disarmament, non-proliferation and arms control; draft resolution XX on information on confidence-building measures in the field of conventional arms; draft resolution XXI, entitled Consolidation of peace through practical disarmament measures; draft resolution XXII on preventing the acquisition by terrorists of radioactive sources; and draft resolution XXIII on Mongolia’s international security and nuclear-weapon-free status.


The Assembly then turned to draft resolution XXIV on a treaty banning the production of fissile material for nuclear weapons or other nuclear explosive devices, by which it would urge the Conference on Disarmament to agree on and implement early in 2013 a balanced and comprehensive programme of work that includes the immediate commencement of negotiations on such a treaty.  It would request the Secretary-General to establish a Group of Governmental Experts, which, taking into account a report containing the views of Member States, will make recommendations on possible elements which could contribute to a treaty.  It will operate on the basis of consensus, without prejudice to national positions in future negotiations and which will meet in Geneva for two sessions of two weeks in 2014 and in 2015. 


The Assembly first considered operative paragraph 3, which concerns the establishment of the group of governmental experts, and adopted this provision by a recorded vote of 156 in favour to 3 against (Iran, Pakistan, Syria), with 27 abstentions.  (Annex XIX)


The Assembly then adopted the draft resolution as a whole by a recorded vote of 166 in favour to 1 against ( Pakistan), with 21 abstentions.  (Annex XX)


Acting without a vote, the Assembly adopted draft resolution XXV on the implementation of the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction, by which it underlined that implementation of the Convention made a major contribution to international peace and security through the elimination of existing stockpiles of chemical weapons and the prohibition of the acquisition or use of chemical weapons, and provided for assistance and protection in the event of use or threat of use.  It noted that the effective application of the verification system built confidence, and it stressed the importance of the Organisation for the Prohibition of Chemical Weapons in verifying that compliance and in promoting the timely and efficient accomplishment of its objectives.


Next, the Assembly turned to draft resolution XXVI on a nuclear-weapon-free southern hemisphere and adjacent areas, by which it would welcome the continued contribution that the Antarctic Treaty and the Treaties of Tlatelolco, Rarotonga, Bangkok and Pelindaba are making towards freeing the southern hemisphere and adjacent areas covered by those treaties from nuclear weapons, and note with satisfaction that all nuclear-weapon-free zones in the southern hemisphere and adjacent areas are now in force.  It would call upon nuclear weapon States to withdraw any reservations or interpretive declarations contrary to the object and purpose of the Treaties.  The Assembly adopted this resolution by a recorded vote of 179 in favour to 4  against (France, Russian Federation, United Kingdom, United States), with 4 abstentions (Federated States of Micronesia, Israel, Marshall Islands, Palau).  (Annex XXI)


The Assembly then turned to draft resolution XXVII on taking forward multilateral nuclear disarmament negotiations, by which it would decide to establish an open-ended working group to develop proposals to take forward such negotiations for the achievement and maintenance of a world without nuclear weapons.  It would also decide that the Group would convene in 2013, in Geneva, for up to three weeks.  The Assembly adopted this resolution by a recorded vote of 147 in favour to 4 against (France, Russian Federation, United Kingdom, United States), with 31 abstentions.  (Annex XXII)


Acting without a vote on draft resolution XXVIII entitled Regional disarmament, the Assembly stressed that sustained efforts are needed, within the framework of the Conference on Disarmament and under the umbrella of the United Nations, to make progress on the entire range of disarmament issues.  It affirmed that global and regional approaches to disarmament complement each other and should, therefore, be pursued simultaneously to promote regional and international peace and security.  It called upon States to conclude agreements, wherever possible, for nuclear non-proliferation, disarmament and confidence-building measures at the regional and subregional levels.


Also without a vote, the Assembly adopted draft resolution XXIX on the illicit trade in small arms and light weapons in all its aspects, by which it encouraged all relevant initiatives towards implementation of the Programme of Action to Prevent, Combat and Eradicate the Illicit Trade in Small Arms and Light Weapons in All Its Aspects, and recognized the urgent need to enhance national controls.  It called upon States to implement the International Tracing Instrument and encouraged them to also implement the recommendations contained in the report of the Group of Governmental Experts established pursuant to resolution 60/81 to consider further steps to enhance international cooperation in preventing, combating and eradicating illicit brokering.


Next, the Assembly turned to draft resolution XXX on united action towards the total elimination of nuclear weapons, according to which it would call upon nuclear-weapon States to undertake further efforts to reduce and ultimately eliminate all types of nuclear weapons, deployed and non-deployed, including through unilateral, bilateral, regional and multilateral measures, emphasizing the importance of the principles of irreversibility, verifiability and transparency.  It would call upon those States to promptly engage with a view to further diminishing the role and significance of nuclear weapons in all military and security concepts, doctrines and policies.


Further to the text, the Assembly would urge all States that have not yet done so to sign and ratify the Comprehensive Nuclear-Test-Ban Treaty (CTBT) at the earliest opportunity, and reiterate its call for the immediate commencement of negotiations on a treaty banning the production of fissile material for nuclear weapons and its early conclusion, and call upon all nuclear-weapon States and States not parties to the NPT to declare and maintain moratoriums on the production of fissile material for any nuclear weapons or other nuclear explosive devices.


Additionally, the Assembly would recognize the legitimate interest of non-nuclear-weapon States in receiving unequivocal and legally binding security assurances from nuclear-weapon States.  It would encourage the establishment of further nuclear-weapon-free zones, where appropriate, and recognize that, by signing and ratifying relevant protocols that contain negative security assurances, nuclear-weapon States would undertake individual legally binding commitments with respect to the status of such zones and not to use or threaten to use nuclear weapons against States parties to such treaties.


The Assembly first considered operative paragraph 2, which concerns accession to the NPT, and adopted it by a recorded vote of 180 in favour to 3 against (Democratic People’s Republic of Korea, India, Israel), with 3 abstentions (Bhutan, Mauritius, Pakistan).  (Annex XXIII)


It then considered operative paragraph 8, which concerns ratification of the CTBT and maintenance of test moratoriums on nuclear-weapon test explosions, adopting that provision by a recorded vote of 182 in favour to 1 against (Democratic People’s Republic of Korea), with 4 abstentions (India, Iran, Mauritius, Syria).  (Annex XXIV)


Operative paragraph 9 concerning the fissile material ban was next adopted by a recorded vote of 177 in favour to 2 against (China, Pakistan), with 8 abstentions (Democratic People’s Republic of Korea, Ecuador, India, Iran, Israel, Mauritius, Russian Federation, Syria).  (Annex XXV)


Operative paragraph 16, which concerns universalization of the comprehensive safeguards agreements of the IAEA, was also adopted by a recorded vote of 178 in favour to 1 against (Democratic People’s Republic of Korea), with 7 abstentions (Argentina, Brazil, India, Iran, Israel, Mauritius, Pakistan).  (Annex XXVI)


Finally, the Assembly adopted the draft resolution as a whole by a recorded vote of 174 in favour to 1 against (Democratic People’s Republic of Korea), with 13 abstentions.  (Annex XXVII)


The Assembly then took up draft resolution XXXI entitled Nuclear disarmament, by which it would recognize that the time is now opportune for all nuclear-weapon States to take effective disarmament measures to achieve the total elimination of these weapons at the earliest possible time.  It would reaffirm that nuclear disarmament and nuclear non-proliferation are substantively interrelated and mutually reinforcing, that the two processes must go hand-in-hand and that there is a genuine need for a systematic and progressive process of nuclear disarmament.


In a related provision, the Assembly would call for the immediate commencement of negotiations in the Conference on Disarmament on a non-discriminatory, multilateral, and internationally and effectively verifiable treaty banning the production of fissile material for nuclear weapons or other nuclear explosive devices.  It would urge the Conference to commence as early as possible its substantive work during its 2013 session, on the basis of a comprehensive and balanced programme of work.


Further to the text, the Assembly would welcome and encourage the efforts to establish new nuclear-weapon-free zones in different parts of the world, including in the Middle East.  It would also encourage the signing of the Protocol to the Treaty on the South-East Asia Nuclear Weapon Free Zone.  It would call upon nuclear-weapon States, pending the achievement of the total elimination of nuclear weapons, to agree on an internationally and legally binding instrument on a joint undertaking not to be the first to use nuclear weapons, and to conclude an internationally and legally binding instrument on security assurances of non-use and non-threat of use of nuclear weapons against non-nuclear weapon States.


The Assembly first adopted operative paragraph 16 concerning negotiations for a fissile material ban by a recorded vote of 178 in favour to 1 against (Pakistan), with 6 abstentions (Armenia, France, Israel, Mauritius, Russian Federation, Uzbekistan).  (Annex XXVIII)


It then adopted the draft resolution as a whole by a recorded vote of 124 in favour to 44 against, with 18 abstentions.  (Annex XXIX)


Acting without a vote, the Assembly next adopted draft resolution XXXII on confidence-building measures in the regional and subregional context, by which it called on Member States to refrain from the use or threat of use of force, and pursue ways and means regarding confidence- and security-building measures, through sustained consultations.  It emphasized that the objective of confidence-building measures should be to strengthen international peace and security, and would encourage bilateral and regional confidence-building measures to avoid conflict.


Next, the Assembly turned to draft resolution XXXIII entitled Conventional arms control at the regional and subregional levels, by which it would express the conviction that conventional arms control needs to be pursued primarily in the regional and subregional contexts since most threats to peace and security in the post-cold-war era arise mainly among States located in the same region or subregion.  It would decide to give urgent consideration to the issues involved.


The Assembly first considered operative paragraph 2, which would request that the Conference on Disarmament consider the formulation of principles that could serve as a framework for regional agreements on conventional arms control.  It adopted this provision by a recorded vote of 150 in favour to 1 against ( India), with 34 abstentions.  (Annex XXX)


It then adopted the draft resolution as a whole by a recorded vote of 185 in favour to 1 against ( India), with 2 abstentions ( Bhutan, Russian Federation).  (Annex XXXI)


Acting without a vote, the Assembly adopted draft decision I entitled Missiles, by which it recalled a handful of its resolutions from 2000 to 2011 and decided to include the item by the same name in the provisional agenda of its sixty-eighth session.


Turning next to draft decision II on transparency in armaments, the Assembly adopted the text by a recorded vote of 162 in favour to none against, with 24 abstentions (Annex XXXII).  According to this text, the Assembly requested the Secretary-General to convene the group of governmental experts, mentioned in paragraph 5 (b) of resolution 66/39, in 2013, without change to the other modalities for the group as elaborated in that paragraph.


The Assembly then adopted draft decision III entitled Open-ended Working Group on the Fourth Special Session of the General Assembly Devoted to Disarmament by a recorded vote of 181 in favour to none against, with 4 abstentions ( France, Israel, United Kingdom, United States).  (Annex XXXIII)


According to the text, the Assembly will hold, at a later date, an organizational session of the group for the purpose of setting a date for its substantive sessions in 2013 and 2014, and include in the provisional agenda of its sixty-eighth session, under the item entitled “General and complete disarmament”, a sub-item entitled “Convening of the fourth special session of the General Assembly devoted to disarmament”.


The Assembly next took up the eight draft texts contained in the report on the review and implementation of the Concluding Document of the Twelfth Special Session of the General Assembly (document A/67/410).


Acting without a vote, the Assembly adopted draft resolution I on the United Nations regional centres for peace and disarmament, by which it reaffirmed the usefulness of the three centres and appealed to Member States in each region, as well as to international governmental and non-governmental organizations and foundations, to make voluntary contributions to the centres in their respective regions in order to strengthen their activities and initiatives.


The Assembly then adopted draft resolution II on a convention on the prohibition of the use of nuclear weapons by a recorded vote of 129 in favour to 49 against, with 10 abstentions (Armenia, Belarus, Georgia, Japan, Kyrgyzstan, Marshall Islands, Republic of Korea, Russian Federation, Serbia, Uzbekistan) (Annex XXXIV).  By its terms, the Assembly expressed determination to achieve that convention, as an important step in a phased programme towards the complete elimination of those weapons within a specified timeframe.  It requested to the Conference on Disarmament to begin those negotiations.


Next, the Assembly adopted the following texts without a vote:  draft resolution III entitled United Nations Regional Centre for Peace and Disarmament in Asia and the Pacific; draft resolution IV on the United Nations Regional Centre for Peace, Disarmament and Development in Latin America and the Caribbean; draft resolution V on the United Nations Disarmament Information Programme; draft resolution VI on United Nations disarmament fellowship, training and advisory services; draft resolution VII on United Nations Regional Centre for Peace and Disarmament in Africa; and draft resolution VIII entitled Regional confidence-building measures:  activities of the United Nations Standing Advisory Committee on Security Questions in Central Africa


The Assembly then turned to the two draft texts contained in the report on review of the implementation of the recommendations and decisions adopted by the General Assembly at its tenth special session (document A/67/411).


Acting without a vote, it adopted draft resolution I entitled Report of the Conference on Disarmament, by which it expressed conviction that the Conference on Disarmament had the primary role in substantive negotiations on priority questions of disarmament.  Noting with renewed concern that no consensus had been reached on a programme of work, the Assembly stressed the urgent need for the Conference to commence its substantive work at the beginning of its 2013 session and called on it to intensify consultations and explore possibilities for overcoming its ongoing deadlock of well over a decade by adopting and implementing a balanced and comprehensive programme of work at the earliest possible date.


The Assembly also adopted without a vote draft resolution II on the Disarmament Commission, by which it recommended that that body continue consideration of the following items at its substantive session in 2013:  recommendations for achieving the objective of nuclear disarmament and non-proliferation of nuclear weapons, and practical confidence-building measures in the field of conventional weapons.


The Assembly then took up the report on the risk of nuclear proliferation in the Middle East (document A/67/412) containing one draft resolution by the same name, according to which it would call on Israel to accede to the NPT without further delay, not to develop, produce, test or otherwise acquire nuclear weapons, renounce possession of those weapons, and place all its unsafeguarded nuclear facilities under full-scope Agency safeguards.  It would welcome the conclusions on the Middle East of the 2010 NPT Review Conference.


Speaking in explanation of position, the representative of Iran said his delegation deeply regretted that the United States had announced that the 2012 conference on a nuclear-weapon-free zone in the Middle East would not be convened, claiming that “States in the region have not agreed to acceptable conditions”.  In fact, Israel was the only country that had not agreed.  The United States said it would not support a conference in which any State was subjected to pressure.  The convening of the conference had been agreed to by parties to the NPT at the 2010 Review Conference.


Also speaking in explanation of position, the representative of Israel said it questioned the motive of the resolution’s sponsors.  Israel always pointed to the risk of nuclear proliferation in the region.  In fact, four of the five non-compliance cases were in the Middle East and the fifth case was the Democratic People’s Republic of Korea.  Those cases had challenged Israel’s security and become a threat to Israel’s existence.  The country expected the international community to look closely into the cases of Iran and Syria – countries that had been the subject of resolutions of the Security Council and the Board of Governors of the International Atomic Energy Agency (IAEA).  The resolution ignored the violations of Iran and Syria, and such a biased text, which reflected the ill-intent of Arab States, would not contribute to the Assembly’s work.


The Assembly first considered preambular paragraph 5, which concerns universalizing the 1995 NPT, retaining that provision by a recorded vote of 180 in favour to 2 against (India, Israel), with 2 abstentions (Bhutan, Pakistan).  (Annex XXXV)


Next, preambular paragraph 6, which calls on States not party to the NPT to accede to it and to accept IAEA safeguards, was adopted by a recorded vote of 180 in favour to 2 against (India, Israel), with 2 abstentions (Bhutan, Pakistan).  (Annex XXXVI)


The Assembly then adopted the draft resolution as a whole by a recorded vote of 174 in favour to 6 against (Canada, Federated States of Micronesia, Israel, Marshall Palau, United States), with 6 abstentions (Australia, Cameroon, Côte d’Ivoire, Ethiopia, India, Panama).  (Annex XXXVII)


Taking the floor in explanation of position following the vote, the representative of Syria said that, during the Assembly’s general debate and the substantive debates of the First Committee, all statements made had welcomed the convening of a conference aimed at creating a zone free of nuclear weapons and weapons of mass destruction in the Middle East.  That conference had been slated to take place in Finland at the end of 2012.  However, not enough optimism had been demonstrated, and the United Nations had not forecast the possibility that the conference might not be held “at the whim of just one party”.  That party itself had nuclear weapons and was far from complying with international requirements.  Indeed, Israel had underscored that it was premature to hold such a conference, using as a pretext the idea that implementing such a zone would demand preconditions and a change of direction in the region.  That argument flouted the fact that Israel was the only country in the region that was a nuclear threat.


In addition, he said, the United States, one of the sponsors of the conference, had called for it to be cancelled due to the “conditions” in the Middle East.  Syria was surprised that those irresponsible statements had not been condemned by countries that generally called for the principles of democracy, legality, international law and non-proliferation, as well as the sacred nature of the NPT.  They had remained silent, in a threatening and dangerous precedent, which undermined the United Nations.  “This is a matter of credibility for the international community” as well as of good faith, he said in that respect.


The delegate of Israel, he recalled, had said discussions in the Committee had resembled an “absurdist piece of theatre”, and he had accused other parties in order to turn eyes away from the true nuclear threat in the Middle East.  Israel must comply with its international obligations and abandon its “enormous” nuclear arsenal.  Indeed, the representative of Israel had made fallacious statements while his country refused to submit its nuclear installations to IAEA inspections.  He urged the international community to put pressure on Israel to accede to the NPT and rid itself of its nuclear arsenal.


When the Assembly next turned to the report on the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons Which May Be Deemed to Be Excessively Injurious or to Have Indiscriminate Effects (document A/67/413), it adopted without a vote the resolution contained therein, according to which, the Assembly called for the universalization of the treaty and its protocols, emphasized the importance of the universalization of the Protocol on Explosive Remnants of War and welcomed the adoption of an accelerated plan of action to promote universality of the Convention and protocols. 


It also adopted without a vote the draft resolution contained within the report on strengthening security and cooperation in the Mediterranean region (document A/67/414), according to which it called on all States of that region to adhere to all the multilaterally negotiated legal instruments related to disarmament and non-proliferation.  It encouraged them to strengthen their cooperation in combating terrorism, including the possible resort by terrorists to weapons of mass destruction, and in combating international crime, illicit arms transfers and illicit drug trafficking.


Taking up the report on the Comprehensive Nuclear-Test-Ban Treaty (document A/67/415), the Assembly considered the draft resolution by the same name, by which it would stress the urgency of its signature and ratification without delay and without conditions in order to achieve its earliest entry into force.  It would urge all States to remain seized of the issue at the highest political level.


The Assembly first adopted preambular paragraph 6 by a recorded vote of 181 in favour to 1 against (Democratic People’s Republic of Korea), with 4 abstentions (India, Israel, Mauritius, Pakistan) (Annex XXXVIII), according to which it welcomed the adoption by consensus of the outcomes of the 2010 NPT Review Conference, which, inter alia, reaffirmed the vital importance of the CTBT’s entry into force as a core element of the international nuclear disarmament and non-proliferation regime and included specific actions to be taken in support of that goal.


The Assembly then adopted the draft resolution as a whole by a recorded vote of 184 in favour to 1 against (Democratic People’s Republic of Korea), with 3 abstentions ( India, Mauritius, Syria).  (Annex XXXIX)


Speaking after the vote, the delegate of Israel said it had voted in favour of the draft, but could not support some of its language linking the NPT Review Conference to the Test-Ban Treaty.  Israel had signed the latter in 1996 and had actively participated in the process since the establishment of its preparatory committee, as well as transmitted data.  As in previous years, Israel’s affirmative vote signified the importance it attached to the Treaty.


Acting without a vote, the Assembly adopted the draft resolution contained in the report on the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on Their Destruction (document A/67/416).  By its terms, the Assembly welcomed the reaffirmation made in the Final Declarations of the Fourth, Sixth and Seventh Review Conferences that under all circumstances the use of bacteriological (biological) and toxin weapons and their development, production and stockpiling are effectively prohibited under the Convention’s article I.  It encouraged States parties to provide, at least biannually, information on their implementation of the treaty’s article X and to collaborate to offer assistance or training in support of legislative and other implementation measures to ensure compliance.


Also adopted without a vote was the draft decision (document L.31) contained in the report on revitalizing the work of the Conference on Disarmament and taking forward multilateral disarmament negotiations (document A/67/417), according to which it would keep the item in the provisional agenda of its sixty-eighth session.


Lastly, the Assembly adopted without a vote the draft decision on the proposed programme of work and timetable of the First Committee for 2013 (document A/67/418).


The Assembly then took note of the report on programme planning (document A/67/419).


Speaking after action on the draft resolution entitled Nuclear Disarmament, the representative of South Africa said his country remained a staunch supporter of a nuclear-weapon-free world.  But there was a need to build on the process undertaken by nuclear-armed States towards the total elimination of nuclear weapons in line with article 6 of the NPT.  The 2010 NPT Review Conference could serve as a foundation.  Implementation of the treaty, including a time frame, should be clearly defined.  South Africa abstained because text in one preambular and two operative paragraphs had contradicted his country’s position.
