REVIEWS, UPDATES ITS GUIDELINES

 


In the light of the adoption of resolution 1822 (2008), and pursuant to paragraph 29 of that resolution, the Security Council Committee, established pursuant to resolution 1267 (1999) concerning Al-Qaida and the Taliban and Associated Individuals and Entities, thoroughly reviewed its Guidelines for the Conduct of its Work and, on 9 December 2008, the Committee adopted an updated version of the Guidelines.  As part of the update, two new sections were added to the Guidelines; one on the reviews of the Committee’s Consolidated List of individuals and entities subject to sanctions measures (Section 9), and one on exemptions from the travel ban (Section 11).  Several existing sections were restructured and/or amended.


The addition of Section 9 pertains to the review of the Consolidated List pursuant to paragraphs 22, 25 and 26 of resolution 1822 (2008).  In paragraph 25, the Security Council directed the Committee to review all names that were inscribed on the Consolidated List at the date of adoption of resolution 1822 (2008) by 30 June 2010, to ensure that the List is as updated and accurate as possible and to confirm that listing remains appropriate.  The Committee initiated the review process in December 2008 following the adoption of the updated Guidelines.  Upon completion of this one-time review, and pursuant to paragraph 26, the Committee will conduct annual reviews of names on the List.  Pursuant to paragraph 22, members of the Committee will also have the possibility to request, on an annual basis, a review of the names on the Consolidated List of individuals that are reported to be deceased.


Section 11 details the procedure for the Committee’s consideration of requests for exemptions from the travel ban set out in paragraph 1(b) of resolution 1822 (2008).


Moreover, the Committee amended Section 10 regarding exemptions to the assets freeze.  This Section now includes more details regarding the information which should be provided by States when submitting notifications and requests for exemptions to the Committee pursuant to resolution 1452 (2002).


In addition, substantive changes have been introduced with a view to reflecting the relevant procedures in a comprehensive manner.  This particularly applies to the sections on the Consolidated List (Section 5), Listing (Section 6), De-listing (Section 7), and Updating the Consolidated List (Section 8).


The revised Guidelines also contain some technical improvements introduced with a view to enhancing accuracy and consistency throughout the text.


The Committee trusts that the revised Guidelines will facilitate the conduct of its own work and provide useful guidance to Member States in their efforts to implement the relevant Security Council resolutions, including resolution 1822 (2008).

The Guidelines have been officially transmitted to all Member States by a note by the Chairman of the Committee.
