4449th Meeting (PM)
SECURITY COUNCIL DECIDES TO LIFT RESTRICTIONS ON ARIANA AFGHAN AIRLINES
The Security Council this afternoon decided to lift restrictions on Ariana Afghan Airlines, as that airline was no longer owned, leased or operated by or on behalf of the Taliban.
Unanimously adopting resolution 1388 (2002), acting under Chapter VII
of the Charter of the United Nations, the Council decided that the provisions
of paragraph 4 (a) and (b) of resolution 1267 (1999) did not apply to Ariana Afghan Airlines aircraft or Ariana Afghan Airlines funds and other financial resources. The Council further decided to terminate the measure provided for by paragraph 8 (b) of resolution 1333 (2000).
[By paragraph 4 (a) of resolution 1267 (1999), the Council had decided that States should deny permission for any aircraft to take off from or land in their territory if it was owned, leased or operated by or on behalf of the Taliban, unless the particular flight had been approved in advance by the Committee of the Security Council established by the same resolution on the grounds of humanitarian need.
By paragraph 4 (b) of that same resolution, the Council had decided that States should freeze funds and other financial resources, including funds derived or generated from property owned or controlled directly or indirectly by the Taliban, as designated by the aforementioned Committee, except as authorized by the Committee on a case-by-case basis on the grounds of humanitarian need.
By paragraph 8 (b) of resolution 1333 (2000), the Council had decided that all States should take measures to close immediately all offices of Ariana Afghan Airlines in their territories.]
The meeting, which began at 12:56 p.m., was adjourned at 12:59 p.m.
