SPECIAL COMMITTEE ON CHARTER BEGINS CONSIDERATION OF DRAFT REPORT OF 1999 SESSION

19990422 The Special Committee on the Charter of the United Nations and on the Strengthening of the Role of the Organization, nearing the end of its 1999 session, this morning began considering its draft final report to the General Assembly.

Examining the draft report, introduced by its Rapporteur, Henry Hanson- Hall (Ghana), the Special Committee adopted, as orally amended, the introduction to it.

The Special Committee began work on the section of the report containing a summary of its debate on "Implementation of Charter provisions related to assistance to third States affected by sanctions". Two draft recommendations to be included in that section were introduced by Ukraine and Germany, on behalf of the European Union.

The Special Committee will meet again at 3 p.m. today to continue consideration of its final report to the General Assembly.

Introduction of Draft Report

HENRY HANSON-HALL (Ghana), Rapporteur of the Special Committee, introducing its draft report (documents A/AC.182/1992/CRP.1-11), said it was divided into six chapters. Chapter I, containing an introduction, and Chapter II, concerning the recommendations of the Special Committee to the General Assembly, were to be found in document A/AC.182/1999/CRP.1. Chapter III, entitled "Maintenance of International Peace and Security", was subdivided into six sections. Section A (document AC.182/1999/CRP.2) contained a summary of the Special Committee's debate on the item "Implementation of Charter provisions related to assistance to third States affected by sanctions (Article 50)" at the current session.

Mr. HANSON-HALL said that Section B, containing a summary of the consideration by the Special Committee of the working paper submitted by the Russian Federation entitled "Some ideas on the basic conditions and criteria for imposing and implementing sanctions and other enforcement measures", was

to be found in document A/AC.182/1999/CRP.3. Section C reflected the Special Committee's consideration of the working paper submitted by the Russian Federation entitled "Fundamentals of the legal basis for United Nations peacekeeping operations in the context of Chapter VI of the United Nations Charter", and was contained in document A/AC.182/1999/CRP.4. Section D contained a summary of the Special Committee's consideration of the working paper submitted by Cuba at the 1997 session of the Special Committee, entitled "Strengthening the role of the Organization and enhancing its effectiveness" and the additional working paper submitted by Cuba at the 1998 session under the same title.

Continuing, he said that Section E reflected the Special Committee's consideration of the revised proposal presented by Libya concerning the strengthening of the role of the United Nations in the maintenance of international peace and security. Both sections D and E were embodied in document A/AC.182/1999/CRP.5. Section F, containing a summary of the Special Committee's consideration of the working paper submitted by the Russian Federation, co-sponsored by Belarus, was to be found in document A/AC.182/1999/CRP.6.

Chapter IV, entitled "Peaceful Settlement of Disputes" contained three sections. Section A was devoted to the Special Committee's consideration of the revised proposal submitted by Sierra Leone entitled "Establishment of a dispute prevention and early settlement service". That discussion was contained in document A/AC.182/1999/CRP.7. Section B, contained in document A/AC.182/1999/CRP.8, reflected the Special Committee's consideration of the working paper entitled "Revised version of the amendments to the Statute of the International Court of Justice", submitted by Guatemala to the Special Committee in 1997 and slightly modified in 1998.

Section C, containing a summary of the Special Committee's consideration of the topic "Practical ways and means of strengthening the International Court of Justice, while respecting its authority and independence" could be found in document A/AC.182/1999/CRP.9. Document A/AC.182/1999/CRP.10 contained Chapter V of the draft report included a summary of the Special Committee's discussion on proposals concerning the Trusteeship Council.

The final chapter, Chapter VI, dealt with the question of the identification of new subjects, assistance to working groups on the revitalization of the United Nations work and coordination between the Special Committee and other working groups dealing with the reform of the Organization. The chapter was embodied in document A/AC.182/1999/CRP.11.
