SECURITY COUNCIL FORWARDS TO GENERAL ASSEMBLY NAMES OF NINE CANDIDATES FOR JUDGES TO INTERNATIONAL CRIMINAL TRIBUNAL FOR FORMER YUGOSLAVIA

19980827 The Security Council this afternoon forwarded to the General Assembly for election, the names of nine candidates for judges for the third Trial Chamber of the International Criminal Tribunal for the Former Yugoslavia, as specified under article 13 (d) of the Tribunal's Statute.

Through its unanimous adoption of resolution 1191 (1998), the Council forwarded the following nominations to the Assembly: Mohamed Bennouna (Morocco), David Hunt (Australia), Per-Johan Lindholm (Finland), Hugo Anibal Llanos Mansilla (Chile), Patrick Robinson (Jamaica), S.W.B. Vadugodapitiya (Sri Lanka), Luis Valencia-Rodriguez (Ecuador), Jan Skupinski (Poland), and Peter H. Wilkitzki (Germany).

The Council took that action following its decision on 13 May to establish a third Trial Chamber of the International Tribunal to enable the Tribunal to try, without delay, the large number of accused currently awaiting trial.

The International Criminal Tribunal for the Former Yugoslavia was established by the Council on 25 May 1993. The election process for its judges begins with an invitation by the Secretary-General to Member States and non-member Observers of the United Nations to submit up to two candidates for the Tribunal within 60 days of his request. The Secretary-General then forwards the nominations received to the Security Council, which establishes "short lists" by secret ballot, taking into account adequate representation of the principal legal systems of the world. The candidates, which consist of not fewer than six names and not more than nine, are then sent to the General Assembly for a final decision].

The full text of resolution 1191 reads as follows:

"The Security Council

"Recalling its resolutions 808 (1993) of 22 February 1993, 827 (1993) of 25 May 1993 and 1166 (1998) of 13 May 1998,

"Having decided to consider the nominations for Judges of the International Criminal Tribunal for the Former Yugoslavia received by the Secretary-General by 4 August 1998,

"Forwards the following nominations to the General Assembly in accordance with article 13 (d) of the Statute of the International Tribunal:
