SECURITY COUNCIL COMMITTEE MONITORING ARMS EMBARGO ON FEDERAL REPUBLIC OF YUGOSLAVIA ADOPTS ITS GUIDELINES AND LAUNCHES AN APPEAL

The following was issued today by the Security Council Committee established pursuant to resolution 1160 (1998), which imposed an arms embargo on the Federal Republic of Yugoslavia, pending action to resolve the crisis in Kosovo:

At its second meeting, on 6 May 1998, the Security Council Committee established pursuant to resolution 1160 (1998) adopted the guidelines for the conduct of its work.

The Committee also decided to address an appeal to all States, international and regional organizations to provide information regarding violations or suspected violations of the prohibitions contained in Security Council resolution 1160 (1998).

The following appeal has been issued today by the Chairman of the Security Council Committee established pursuant to resolution 1160 (1998), Ambassador Celso L.N. Amorim (Brazil), on behalf of the Committee:

Appeal to All States, International and Regional Organizations To Provide Information on Violations or Suspected Violations Of Prohibitions Imposed by Security Council Resolution 1160 (1998)

1. On 31 March 1998, acting under Chapter VII of the Charter of the United Nations, the Security Council imposed the prohibitions contained in paragraph 8 of resolution 1160 (1998). In paragraph 10 of the resolution, the Council called upon all States, international and regional organizations to act strictly in conformity with the resolution. Paragraphs 8 and 10 of the resolution, respectively, read as follows:

"8. Decides that all States shall, for the purposes of fostering peace and stability in Kosovo, prevent the sale or supply to the Federal Republic of Yugoslavia, including Kosovo, by their nationals or from their territories or using their flag vessels and aircraft, of arms and related matériel of all types, such as weapons and ammunition, military vehicles and equipment and spare parts for the aforementioned, and shall prevent arming and training for terrorist activities there;

"10. Calls upon all States and all international and regional organizations to act strictly in conformity with this resolution,

notwithstanding the existence of any rights granted or obligations conferred or imposed by any international agreement or of any contract entered into or any license or permit granted prior to the entry into force of the prohibitions imposed by this resolution, and stresses in this context the importance of continuing implementation of the Agreement on Subregional Arms Control signed in Florence on 14 June 1996."

2. By paragraph 9 of the above resolution, the Council decided to establish a committee, consisting of all the members of the Council, to undertake the following tasks and to report on its work to the Council with its observations and recommendations:

"(a) to seek from all States information regarding the action taken by them concerning the effective implementation of the prohibitions imposed by this resolution;

"(b) to consider any information brought to its attention by any State concerning violations of the prohibitions imposed by this resolution and to recommend appropriate measures in response thereto;

"(c) to make periodic reports to the Security Council on information submitted to it regarding alleged violations of the prohibitions imposed by this resolution;

"(d) to promulgate such guidelines as may be necessary to facilitate the implementation of the prohibitions imposed by this resolution;

"(e) to examine the reports submitted pursuant to paragraph 12 of this resolution."

3. The Committee, in pursuance of its mandate, wishes to launch an appeal to all States, international and regional organizations to provide information on violations or suspected violations of the prohibitions imposed by Security Council resolution 1160 (1998). The information hereby requested should be addressed to: Chairman of the Security Council Committee established pursuant to resolution 1160 (1998), through the United Nations Secretariat, Room S-3055E, United Nations Plaza, New York, N.Y. 10017, United States (Fax (212) 963 1300).

4. The rule of the Committee for reaching decisions will be by consensus. The Committee will hold its meetings in private (closed) sessions unless for any purpose, the Committee decides otherwise.
