ASSEMBLY ASKED TO ENSURE DEVELOPMENT RIGHTS TO NATURAL RESOURCES IN NON-SELF-GOVERNING TERRITORIES
19961120 Committee Text Seeks Cooperation of Administering Powers; Drafts on Military Activities, Safety of UN Personnel Also ApprovedThe General Assembly would urge administering Powers to safeguard the inalienable right of peoples of colonial and Non-Self-Governing Territories to their natural resources, and to establish control over the future development of those resources, according to a draft resolution approved this afternoon by the Fourth Committee (Special Political and Decolonization).
By further terms of the text, approved as orally amended by a recorded vote of 87 in favour, to 44 against, with no abstentions, the Assembly would call upon the administering Powers to ensure that no discriminatory working conditions prevailed in those Territories, and to promote a fair system of wages. It would decide that all economic activities in the Territories would promote their economic and financial viability. (See Annex XX.)
The Committee approved a draft amendment on the language of that text, submitted by Ireland on behalf of the European Union. By that amendment, approved without a vote, the Assembly would reaffirm the right of peoples of Non-Self-Governing Territories to self-determination in conformity with the United Nations Charter.
Nineteen other amendments to the draft were also offered by the European Union. The deletion of some references to "colonial" territories was proposed. One amendment would have replaced a reference to "implementation of the Declaration (on decolonization)". All those amendments were defeated in recorded votes. (See Annexes I through XIX.)
According to a draft resolution on the Convention on the Safety of United Nations and Associated Personnel, approved by the Committee without a vote, the Assembly would urge all States to consider ratifying, accepting, approving or acceding to the Convention in order to bring about its entry into force at the earliest possible date.

Prior to approval of the draft as a whole, the Committee approved an oral amendment by which the Secretary-General would be asked to continue to facilitate the dissemination of information relating to the Convention and to promote its wider appreciation.
Also this afternoon, in a draft decision on military activities and arrangements approved by the Committee by a recorded vote of 87 in favour, to 46 against, with no abstentions, the Assembly would urge the administering Powers of Non-Self-Governing Territories not to involve those Territories in any offensive acts or interference against other States. It would further call upon those administering Powers to terminate such activities and to eliminate those military bases which impede decolonization. (See Annex XXI.)
The Secretary of the Committee read a statement of the budgetary implications of the draft on peace-keeping operations.
Statements were made by Iran, Georgia, New Zealand, Zimbabwe, Jordan, Fiji, United States, Ireland, China, Ukraine, Cuba, Papua New Guinea, Costa Rica, Colombia.
The Committee will meet again at 10 a.m. on Friday, 22 November to continue taking action on decolonization drafts.
Committee Work Programme
The Fourth Committee (Special Political and Decolonization) met this afternoon to continue its consideration of peace-keeping matters and to take action on draft resolutions on peace-keeping operations in all their aspects, and on draft resolutions offering amendments to previously introduced drafts on decolonization matters.
Before the Committee is a draft resolution on peace-keeping in all its aspects (document A/C.4/51/L.9) which would have the Assembly decide to expand the membership of the Special Committee in accordance with the provisions of its report. Those Member States which are past or present personnel contributors to United Nations peace-keeping operations and those which were observers at the 1996 session of the Special Committee should, upon request in writing to the Chairman of the Committee, become members at its 1997 session. It would also decide that those Member States which become personnel contributors to United Nations peace-keeping operations in years to come or participate in the future in the Special Committee for three consecutive years as observers should, upon request in writing to the Chairman of the Committee, become members at the following session of the Committee.
By the draft, the Assembly would endorse the proposals, recommendations and conclusions of the Special Committee and urge Member States, the Secretariat and relevant organs of the United Nations to take all necessary steps to implement them.
Also by the draft, the Assembly would recommend that, should any of the proposals contained in the text result in budgetary implications for the bienniums 1996-1997 and 1998-1999, such additional costs should be accommodated within the appropriation levels approved by the Assembly for those bienniums, in accordance with the Financial Regulations and Rules of the Organization.
The Assembly would further decide that the Special Committee, in accordance with its mandate, should continue its efforts for a comprehensive review of the whole question of peace-keeping operations in all their aspects, including a review of the implementation of its previous proposals, and should consider new proposals so as to enhance the capacity of the United Nations to fulfil its responsibilities in that field.
The draft is sponsored by Argentina, Canada, Egypt, Japan, Nigeria and Poland.
Another draft before the Committee (document A/C.4/51/L.10) concerns the Convention on the Safety of United Nations and Associated Personnel. Under its provisions, the Assembly would welcome all signatures, ratifications,

acceptances, approvals and accessions to the Convention. It would urge all States that have not yet done so to consider ratifying, accepting, approving or acceding to the Convention, to bring about its entry into force at the earliest possible date.
Also by the draft, the Secretary-General would be requested, within existing resources, to take the necessary steps to facilitate the dissemination of information relating to the Convention and to promote its wider appreciation. He would also be requested to inform the Assembly at its fifty-third session on the status of the Convention and on steps taken relating to it.
The draft is sponsored by Australia, Bangladesh, Belgium, Bolivia, Brazil, Denmark, Fiji, Finland, France, Germany, Haiti, Honduras, Italy, Japan, Kyrgyz Republic, Liechtenstein, Malta, New Zealand, Norway, Panama, Philippines, Poland, Portugal, Romania, Samoa, Sierra Leone, Singapore, Slovak Republic, Sweden, Togo, Tunisia, Ukraine, United Kingdom, United States, Uruguay and Uzbekistan.
By the text of the draft resolution on activities of foreign economic and other interests which impede the implementation of the Declaration contained in paragraph 12 of the Report of the Special Committee on decolonization (document A/51/23 [Part III]), the General Assembly would urge administering Powers concerned to take effective measures to safeguard the inalienable right of the peoples of the colonial and Non-Self-Governing Territories to their natural resources and to establish control over the future development of those resources.
The Assembly would also be called upon to ensure that no discriminatory working conditions prevailed in the Territories under their administration and to promote a fair system of wages. The Assembly would also seek to ensure that all economic activities in the Non-Self Governing Territories are aimed at promoting the economic and financial viability of those Territories, in order to facilitate and accelerate the exercise by the peoples of those Territories of their right to self-determination and independence.
The text of a draft resolution on foreign economic activities (document A/C.4/51/L.2) offers amendments to the draft resolution contained in the report of the Committee on decolonization (document A/51/23 [Part III]), Chapter V, paragraph 12. Among 16 proposed changes of wording, the amendment would recommend that the text relating to the right to natural resources to apply to the peoples of Non-Self-Governing Territories, deleting the words "colonial and". It is proposed that the reference in another operative paragraph of the original text to informing world public opinion about "those activities of foreign economic and other economic interests which impede the Declaration (on decolonisation)" be replaced by "the necessity to avoid

damaging exploitation of the natural resources of the Non-Self-Governing Territories".
In part VI of the Report of the Committee on decolonization is a draft decision concerning military activities and arrangements by colonial Powers in Territories under their administration. It would have the Assembly urge the administering Powers concerned not to involve those Territories in any offensive acts or interference against other States. They would also be called upon to terminate such activities and to eliminate such military bases which impede the implementation of the Declaration on decolonization.
Part IV of the Special Committee's report contains a draft resolution on the specialized agencies' implementation of the Declaration on decolonization. Under its provisions, the agencies would be requested to formulate appropriate assistance programmes for the Territories. The Assembly would also request the administering Powers concerned to facilitate the participation of representatives of those Territories in relevant meetings and conferences of specialized agencies.
Also before the Committee is a draft resolution on implementation of the declaration on the granting of independence to colonial countries and peoples (document A/C.4/51/L.11), containing amendments to the draft resolution recommended by the Special Committee on decolonization (document A/51/23 [Part IV]), Chapter X, paragraph 17.
By the terms of draft Resolution A - General, operative paragraph 1 would replace "For Approves" with "takes note of".
In operative paragraph 3, "of the legitimate political status options open to them in the exercise of their right to self-determination" would be replaced by: "of their right to self-determination in conformity with legitimate political status options, including those defined in resolution 1541 (XV)".
In operative paragraph 4, the existing text would be replaced by: "4. Requests the administering Powers to report to the Secretary-General on the wishes and aspirations of the people of the Territories regarding their political status as expressed in any referendums and other forms of popular consultation, including free and fair elections conducted by the Governments of the Territories; "4 bis. Requests the administering Powers to report to the Secretary-General the results of any informed and democratic processes conducted by the Governments of the Territories which indicate the clear and freely expressed wish of the people to change the existing status of the Territory;".
Operative paragraph 5 would be deleted.

In operative paragraph 6, the existing text would be replaced by: "Reaffirms that visiting United Nations missions to the Territories, at an appropriate time and in consultation with the administering Power, are one effective means of ascertaining the situation in the Territories, and requests the administering Powers to keep the possibility of such missions under review;".
Operative paragraph 10 would be deleted.
In operative paragraph 13, the existing text would be substituted by: "13. Requests the Special Committee to report to the General Assembly at its fifty-second session on all relevant information received pursuant to the present resolution".
By the terms of the draft, draft resolution B.VI - Guam would be amended as follows:
In operative paragraph 1: "facilitate the exercise of self-determination by the Chamorro people of Guam for the Territory, as endorsed by the people of Guam in the draft Guam Commonwealth Act", would be replaced by "receive an expression of the will of the Chamorro people";
In operative paragraph 3, "orderly" would be inserted before "transfer";
In operative paragraph 4, "the people of Guam, including" would be inserted before "the Chamorro people";
In operative paragraph 5, (a) For "implement" read "cooperate in establishing" (b) For "enterprises by the Chamorro people" read "enterprises by the people of Guam, including the Chamorro people".
In the draft resolution B.IX - St. Helena, operative paragraph l would be replaced as follows: "1. Notes that the administering Power has noted various statements made by members of the Legislative Council about the Constitution and is prepared to discuss these further with the people of St. Helena, and further notes that the Commonwealth Parliamentary Association recently sent a delegation to study the Constitution and its application with the Legislative Council".
The amended draft resolution is sponsored by the United Kingdom of Great Britain, Northern Ireland and the United States of America.

Statements
MEDHDI DANESH-YAZDI (Iran) said United Nations peace-keeping operations had experienced successes and failures. Those operations should never be regarded as a substitute for the pacific settlement of disputes as spelled out in the United Nations Charter. Peace-keeping measures should strictly observe full respect for the sovereignty and sovereign equality of all States, their territorial integrity and non-intervention in their internal affairs.
The lessons of recent years confirmed that obtaining prior consent of the parties, impartiality, and non-use of force were among the key elements of the success of the United Nations peace-keeping operations. There should be no attempt to divert funds to peace-keeping at the expense of development activities, he said. There was no better way of achieving peace than to promote development and giving those activities a stable character throughout the world.
Elaboration of a code of conduct for peace-keepers would contribute to the success of peace-keeping efforts, enhancing their credibility worldwide, he added. Those efforts were different from other field operations. As such, the operations of humanitarian assistance and post-conflict peace-building should be distinct from peace-keeping operations. Expanding the membership of the Special Committee on Peace-keeping Operations was welcome, as was the draft resolution in that regard.
ZAAL GOGSADZE (Georgia) said timely application of preventive diplomacy could prevent acts of violence and ease tensions. Positive results could be achieved with a small number of peace-keepers. Preventive diplomacy measures should be applied as early as possible; to delay planned operation until the conflict was over was not the answer. Agreement on a peaceful settlement had to be achieved on a step-by-step basis.
He spoke of the value of police functions in peace-keeping forces. Despite United Nations activity concerning the situation in Georgia, conditions in that tormented region were still dangerous, he added. More than three years had passed without significant progress, and 300,000 refugees were still awaiting their fate.
He supported the establishment of a rapidly deployable mission headquarters, as well as using rapidly deployable United Nations military observers. That could help the first rapid forces fulfil their tasks. Given the continuing acts of violence against United Nations personnel, Georgia also supported the improvement of measures for their protection and would support the entry into force of the Convention on the Safety of United Nations and Associated Personnel.

PETER RIDER (New Zealand) said the United Nations must be careful about mixing enforcement and peace-keeping tasks. For enforcement operations under Chapter VII, peacekeepers must be appropriately configured and equipped. The Security Council should be wary about passing resolutions that could not or would not be effected. The United Nations should not write itself out of the script when enforcement was contemplated. It should not simply act as a rubber stamp for great Power action. Rapid response was an area where more could be done. He welcomed the work on the rapidly deployable mission headquarters. Redressing imbalances in staffing would take time, but that work should not occur at the expense of maintaining an effective Department.
He said de-mining was an important focus for his country; necessary resources should be made available for that work. He welcomed the call by the peace-keeping committee for more coordination in this area of work. More than $1 billion was owed for peace-keeping troops and equipment. That situation was not sustainable, and it was vital that outstanding contributions be paid toward that outstanding debt. He urged all Members to give positive consideration to the draft resolution (A/C.4/51/L.10) on the Convention on the Safety of United Nations Personnel, introduced by Ukraine and cosponsored by a number of countries, including his own.
TOBIAS MAPURANGA (Zimbabwe) said he associated his delegation with the statement of Thailand on behalf of the Non-Aligned Movement. Africa had long indicated its willingness to participate in regional arrangements. The fourth convention of the Organization of African Unity (OAU) Mechanism for Conflict Prevention, Management and Resolution had issued its communique outlining its views on the crisis in the Great Lakes region. Peace-keeping operations should be guided by the principles of the Charter regarding the independence of States, the non-intervention in domestic matters of States, impartiality and the non-use of force except in self-defense. He welcomed the establishment of the Lessons Learned Unit in the Department of Peace-keeping Operations (DPKO). He supported a uniform scale for death and disability reimbursement.
He said efforts should be made to contain the number of "loaned staff" in the Department to not more than 50 percent of the total. That trend involving the privatization of the Secretariat should not continue. He welcomed the proposed expansion of the Special Committee on Peace-keeping so that its membership became more representative.
ZEID RAAD ZEID AL HUSSEIN (Jordan) said his country, over the past seven years, had become one of the leading troop-contributing countries. The Special Committee's recommendation to expand its membership was welcome.
He deeply regretted that the United Nations was unable to reimburse troop-contributing countries for equipment, owing to the fact that a number of

Member States had not made their payments. Jordan and the other leading-troop contributors were being punished in that regard, "and the pain has penetrated beyond the flesh and is now striking the bone". His country had also paid a heavy human price for its participation in peace-keeping operations. Furthermore, it was totally unacceptable and morally objectionable that the United Nations should compensate families of deceased or disabled United Nations personnel by criteria relating to the nationality of the affected individual. It was high time that the Committee re-examined that very important issue.
He commended the establishment of a Mission Planning Service and a Training Unit, and strongly backed efforts to establish a rapidly deployable mission headquarters capability. Meetings between the Security Council members and troop contributors should become institutional practice, and periodic reports on the situations in each of the peace-keeping missions would be favoured.
POSECI W. BUNE (Fiji) said the Organization must establish a system of preventive diplomacy. Urgent actions should be taken to set up a special department or unit to that end. "We should take every possible step within our power to prevent fires, rather than having to put them out, to save lives rather than condemning the loss of lives". He welcomed the offer of Norway to establish a fund for preventive action at the United Nations. He also welcomed the call for establishing a uniform scale for death and disability compensation for United Nations personnel. He supported expanding the membership of the Special Committee on Peace-keeping.
Action on Texts
The representative of Canada introduced the draft resolution on the whole question of peace-keeping operations in all their aspects (document A/C.4/51/L.9) endorsing the proposals, recommendations, and conclusions of the Report of the Special Committee on Peace-keeping Operations contained in document A/51/130.
Statement Regarding Programme Budget Implications
Speaking on the draft resolution on peace-keeping operations in all their aspects, ABDUR RAZZAQUE KHAN, Special Committee Chairman, said paragraphs 47, 50, 61, 62 and 74 of that document contained recommendations that would have budgetary implications.
He said that paragraph 47 would have the Secretary-General and the General Assembly take steps to provide financing for recruitment to posts presently occupied by officers on loan. There were presently 115 such

officers on loan to the DPKO. United Nations funding for those posts would total $22,845,400 for the two-year period from 1998 to 1999.
Paragraph 50 of that text urged the Secretary-General to seek regular, predictable financing for the Lessons Learned Unit, he said. The estimated personnel costs of those funded from voluntary contributions were $1,116,250. The estimated translation costs were $86,270. Paragraph 61 requested that, where practicable, the linguistic composition of peace-keeping operations be taken into account. Provision of $125,450 for manuals and handbooks would be required.
Paragraph 62, urging the Secretary-General to strengthen the Civilian Police Unit further, would require $638,400 for a two-year period, he said. Paragraph 74, urging the Secretary-General to give high priority to early settlement of pending claims, including those for equipment, would involve estimated costs of $2,693,600 for the two-year period. That estimate was already included in the projected costs associated with the financing of officers on loan.
Statements
The representative of the United States said the functions indicated were covered by the peace-keeping implications account. They were associated with functions funded by that account. Why were those costs not to be included in that account? she asked.
The representative of Ireland asked whether a programme budget implications report would be produced on that resolution. If it would be, action by the Committee on the draft should wait for that report to be produced.
The Chairman of the Committee, Alounkeo Kittikhoun, (Lao People's Democratic Republic), said the report was being produced.
The representative of Ireland said that action should be postponed until the report was available.
The representative of China said he had a different opinion on operative paragraph 4. That should be discussed by the Fifth Committee. It was not within the mandate of this Committee. He recommended, therefore, that that paragraph be removed.
The Chairman proposed that the Committee postpone action on that draft until Friday, 22 November. The representative of Ireland said he would be delighted to defer action on the draft until Friday, if the programme budget implication statement were available prior to that time. The Chairman said

the Secretariat had informed him that it would make its best effort to have that document available.
The representative of Ukraine introduced the draft resolution on the Convention on the Safety of United Nations and Associated Personnel (document A/C.4/51/L.10). It would draw the international community's attention to the problem, and give all States a political message acceding to the Convention and enhance public awareness of that important instrument.
The safety of United Nations personnel should be significantly improved, he said. Since 1995, 56 peace-keepers had lost their lives fulfilling their noble missions. Arrangements for the protection of United Nations personnel must be strengthened, and the Convention would be a step forward in that direction.
He introduced an oral revision to the draft which would amend operative paragraph 3 as follows: "request the Secretary-General to continue to take the necessary steps to facilitate the dissemination of information relating to the Convention and to promote its wider appreciation".
The amendment to the draft was approved without a vote.
The representative of Cuba shared the concern expressed for United Nations personnel to receive adequate safety. Cuba's association with the text, however, did not mean it changed its position on the Convention, with which it had already expressed some reservations.
The draft was approved by the Committee without a vote.
The representative of the United States said in regard to the text on peace-keeping operations, the Committee should be provided with a minimum of 24 hours to review the programme budget implications document before taking up that draft.
The Committee then took up the draft resolution on foreign economic and other interests (document A/51/23 [part 3]) as well as amendments contained in document A/C.4/51/L.2.
The representative of Ireland, speaking on behalf of the European Union, introduced the amendments to the draft text.
The representative of Papua New Guinea, on behalf of the Special Committee on Decolonization, said he had consulted on those amendments with the Special Committee as a whole and was prepared to accept two of the amendments offered by Ireland on behalf of the European Union, but not the

remainder. The draft addressed the economic and resources issues affecting the people of the Non-Self-Governing Territories.
He found acceptable amendment 6 paragraph 1 of the draft proposal, with the exception that he would add, "countries and people", as well as "the enjoyment of resources in their best interest".
He continued that the Committee had no objection to amendment 7 of that document, provided that paragraph 3 of the resolution was retained, "in other words, as 3 bis.". The Committee as a whole could not accept those other proposed amendments.
The representative of Costa Rica, speaking in explanation of vote, said he supported the position of the representative of Papua New Guinea. The amendment contained in paragraph 2 could be harmful to the self-determination of peoples.
The representative of Cuba said he regretted that the Committee had before it the long series of amendments to the resolution being offered by the Special Committee. The repetition of amendments offered last year should not have been necessary. Many of the ideas offered as amendments last year had been taken into account in the drafting of the present text. He agreed with the statement of the representative of Papua New Guinea.
The representative of China supported the statement of the representative of Papua New Guinea on behalf of the Special Committee on Decolonization. He hoped the delegates could support that position.
The representative of Colombia associated himself with the statement of Papua New Guinea. He said the Non-Aligned Movement had always supported the efforts of the Special Committee and its principles were represented in the resolution drafted by the Special Committee.
The representative of Ireland said that the additional amendments proposed by the representative of Papua New Guinea were acceptable.
Addressing the proposed amendment of the representative of Papua New Guinea, the representative of the United Kingdom said he could not accept the present paragraph 3, and therefore would not be able to accept that amendment.
The Committee then defeated the amendment contained in paragraph 1 by a vote of 49 in favour to 56 against, with 18 abstaining. (See Annex I.)
The Committee then proceeded to defeat the amendment contained in paragraph 2 by a vote of 46 in favour to 62 against, with 17 abstaining. (See Annex II.)
