CHARTER COMMITTEE POSTPONES CONCLUSION OF SESSION UNTIL TODAY

19960306 The Special Committee on the Charter of the United Nations and on the Strengthening of the Role of the Organization yesterday afternoon postponed until today the conclusion of its scheduled two-week session when it is expected to approve its report to the General Assembly. It took the action at the behest of the representative of France who said he could not continue with the meeting without interpretation, discontinued after 6 p.m.

During yesterday's meetings, the Committee had begun approving the various parts of its draft report, which containED recommendations and summaries of discussions held in plenary and working group. It approved most of Chapters III (maintenance of international peace and security), IV (peaceful settlement of disputes), V (future of Trusteeship Council) and VI (publications concerning repertory of United Nations practice) in the afternoon, with some amendments, recommendations and proposals outstanding.

Chapter I was adopted yesterday morning, containing reports on the Committee's actions such as the adoption of its agenda, organization of work and election of officers. Chapter II, on recommendations, was not available since the Committee had not agreed on any. Recommendations agreed upon would be reflected in the final report. Therefore, the draft report so far before the Committee mainly contains summaries of views expressed.

The Committee's draft report was introduced yesterday morning by its rapporteur, Martin Smejkal (Czech Republic), who said that it was divided into seven Chapters presented in several conference room working papers. Chapter III, he went on, dealt with the maintenance of international peace and security. In that regard, it referred to the question of implementing the provision of the Charter on assistance to third States affected by sanctions imposed under Chapter VII of the Charter. The draft presents discussions on the proposal by Libya on strengthening the Organization's role in maintaining international peace and security. Working group discussions on Cuba's revised working paper on strengthening the role of Organization and enhancing its effectiveness are also contained in the draft report's Chapter III. The issue of the peaceful settlement of disputes between States is contained in Chapter IV of the draft report, which reflects discussions on Sierra Leone's proposal on establishing a dispute settlement service.

The draft report's Chapter V deals with the future of the Trusteeship Council. Draft Chapter VI dwells on the status of the United Nations Repertory of Practice of the United Nations Organs and the Repertoire of the Practice of the Security Council. When the Committee resumes its deliberations today, it is scheduled to consider a recommendation on the subject proposed by Italy, on behalf of the European Union.

It would also consider new subjects identified for the Committee's future work as contained in draft Chapter VII. Among its contents are discussions on a working paper submitted by the Russian Federation on a draft General Assembly declaration on the basic principles and criteria for the work of United Nations peace-keeping missions and mechanisms for preventing and settling conflicts.

The Special Committee is mandated to examine issues relating to the maintenance of international peace and security, the peaceful settlement of disputes, the strengthening of the role of the Organization and the future of the Trusteeship Council.

The Committee is scheduled to meet again after the conclusion of today's General Assembly plenary meeting, due to start at 10:30 a.m.
