CHARTER COMMITTEE BEGINS CONSIDERATION OF REPORT TO GENERAL ASSEMBLY

19960305 The Special Committee on the Charter of the United Nations and on the Strengthening of the Role of the Organization this morning began considering its draft report to the General Assembly.

Introducing the draft report to the Committee Rapporteur Martin Smejkal (Czech Republic) said that it was divided into seven Chapters presented in several conference room working papers. Chapter I, the only one so far adopted by the Committee, contains the introduction to the draft report and reports on Committee actions such as the adoption of its agenda, organization of work and election of officers.

Chapter II, which will contain the Committee's recommendations, was not yet available, he said. Any recommendations that were agreed upon today would be reflected in the final report.

Chapter III, he went on, dealt with the maintenance of international peace and security. In that regard, it referred to the question of implementing the provision of the Charter on assistance to third States affected by sanctions imposed under Chapter VII of the Charter. The draft presents discussions on the proposal by Libya on strengthening the Organization's role in maintaining international peace and security. Working group discussions on Cuba's revised working paper on strengthening the role of Organization and enhancing its effectiveness are also contained in the draft report's Chapter III.

He said the issue of the peaceful settlement of disputes between States is contained in Chapter IV of the draft report, which reflects discussions on Sierra Leone's proposal on establishing a dispute settlement service offering or responding with its services early in disputes.

The draft report's Chapter V deals with the future of the Trusteeship Council, he added. Chapter VI dwells on the status of the United Nations Repertory of Practice of the United Nations Organs and the Repertoire of the Practice of the Security Council. New subjects identified for the Committee's future work are contained in Chapter VII. Among its contents are discussions on a working paper submitted by the Russian Federation on a draft declaration on the basic principles and criteria for the work of the United Nations peace-keeping missions and mechanisms for preventing and settling crises and conflicts.

The Special Committee is mandated to examine issues relating to the maintenance of international peace and security, the peaceful settlement of disputes, the strengthening of the Role of the Organization and the future of the Trusteeship Council.

The Committee is scheduled to meet again at 3 p.m. today to adopt its draft report.
